| 7 | 7 | | relating to the rates charged by certain conservation and |

| 8 | 8 | | reclamation districts for potable water or wastewater service to |

| 9 | 9 | | recreational vehicle parks. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 49.2122, Water Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (a-1) to read as follows: |
|---|
| 13 | 13 | | (a-1) Notwithstanding Subsection (a), a district that |
|---|
| 14 | 14 | | provides nonsubmetered master metered utility service, as defined |
|---|
| 15 | 15 | | by Section 13.087(a)(1), to a recreational vehicle park, as defined |
|---|
| 16 | 16 | | by Section 13.087(a)(3), shall determine the rates for that service |
|---|
| 17 | 17 | | on the same basis the district uses to determine the rates for other |
|---|
| 18 | 18 | | commercial businesses that serve transient customers and receive |
|---|
| 19 | 19 | | nonsubmetered master metered utility service from the district. |
|---|
| 20 | 20 | | SECTION 2. The change in law made by this Act does not apply |
|---|
| 21 | 21 | | to a rate established for nonsubmetered master metered utility |
|---|
| 22 | 22 | | service entered into by a district and a recreational vehicle park |
|---|
| 23 | 23 | | before the effective date of this Act. A rate established for |
|---|
| 24 | 24 | | nonsubmetered master metered utility service entered into by a |
|---|
| 25 | 25 | | district and a recreational vehicle park before the effective date |
|---|
| 26 | 26 | | of this Act is governed by the law in effect on the date the rate was |
|---|
| 27 | 27 | | established, and the former law is continued in effect for that |
|---|
| 28 | 28 | | purpose. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2011. |
