77 relating to the use of facsimile signatures for certain documents
88 involving certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 618.002(3), Government Code, is amended
1111 to read as follows:
1212 (3) "Eligible contract" means a written evidence of
1313 agreement, including a contract, purchase order, and surety bond,
1414 and any related document, including an application, certificate,
1515 and approval, other than a public security or instrument of
1616 payment, that is executed, authenticated, certified, or endorsed
1717 for or on behalf of a home-rule municipality with a population of
1818 200,000 [1.9 million] or more.
1919 SECTION 2. Section 342.007(b), Health and Safety Code, is
2020 amended to read as follows:
2121 (b) To obtain a lien against the property, the mayor,
2222 municipal health authority, or municipal official designated by the
2323 mayor must file a statement of expenses with the county clerk of the
2424 county in which the municipality is located. The lien statement
2525 must state the name of the owner, if known, and the legal
2626 description of the property. A signature on a lien statement may be
2727 a facsimile signature as defined by Section 618.002, Government
2828 Code. The lien attaches upon the filing of the lien statement with
2929 the county clerk.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2011.
