99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the election of the members of the Board of Port
1212 Commissioners of the Port of Port Arthur Navigation District of
1313 Jefferson County.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Sections 9(a) and (c), Chapter 197, Acts of the
1616 58th Legislature, Regular Session, 1963, are amended to read as
1717 follows:
1818 (a) The District shall hold an election in the District to
1919 elect the appropriate number of port commissioners as required to
2020 maintain a full Board of Port Commissioners on the uniform election
2121 date in [first Saturday of] May in each odd-numbered year [at which
2222 time there shall be elected five (5) Port Commissioners].
2323 (c) Port [Except as provided by Subsection (d) of this
2424 section, the] commissioners serve staggered six-year [four-year]
2525 terms.
2626 SECTION 2. (a) A port commissioner who on the effective
2727 date of this Act serves on the Board of Port Commissioners of the
2828 Port of Port Arthur Navigation District of Jefferson County shall
2929 continue in office until a successor is elected and qualified.
3030 (b) Port commissioners of the Port of Port Arthur Navigation
3131 District of Jefferson County shall serve six-year terms of office
3232 beginning with terms of port commissioners elected at the election
3333 held in 2013, in accordance with Sections 9(a) and (c), Chapter 197,
3434 Acts of the 58th Legislature, Regular Session, 1963, as amended by
3535 this Act.
3636 SECTION 3. (a) The legal notice of the intention to
3737 introduce this Act, setting forth the general substance of this
3838 Act, has been published as provided by law, and the notice and a
3939 copy of this Act have been furnished to all persons, agencies,
4040 officials, or entities to which they are required to be furnished
4141 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4242 Government Code.
4343 (b) The governor, one of the required recipients, has
4444 submitted the notice and Act to the Texas Commission on
4545 Environmental Quality.
4646 (c) The Texas Commission on Environmental Quality has filed
4747 its recommendations relating to this Act with the governor, the
4848 lieutenant governor, and the speaker of the house of
4949 representatives within the required time.
5050 (d) All requirements of the constitution and laws of this
5151 state and the rules and procedures of the legislature with respect
5252 to the notice, introduction, and passage of this Act are fulfilled
5353 and accomplished.
5454 SECTION 4. Except as provided by Section 2(b) of this Act,
5555 this Act takes effect immediately if it receives a vote of
5656 two-thirds of all the members elected to each house, as provided by
5757 Section 39, Article III, Texas Constitution. If this Act does not
5858 receive the vote necessary for immediate effect, this Act takes
5959 effect September 1, 2011.
