99 AN ACT
1010 relating to certain defenses to prosecution for the offense of
1111 sale, distribution, or display of harmful material to a minor.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 43.24, Penal Code, is amended by
1414 amending Subsection (c) and adding Subsection (c-1) to read as
1515 follows:
1616 (c) It is an affirmative [a] defense to prosecution under
1717 this section that[:
1818 [(1)] the sale, distribution, or exhibition was by a
1919 person having scientific, educational, governmental, or other
2020 similar justification[; or
2121 [(2) the sale, distribution, or exhibition was to a
2222 minor who was accompanied by a consenting parent, guardian, or
2323 spouse].
2424 (c-1) It is a defense to prosecution under this section that
2525 the actor was the spouse of the minor at the time of the offense.
2626 SECTION 2. The change in law made by this Act applies only
2727 to an offense committed on or after the effective date of this Act.
2828 An offense committed before the effective date of this Act is
2929 governed by the law in effect at the time the offense was committed,
3030 and the former law is continued in effect for that purpose. For
3131 purposes of this section, an offense was committed before the
3232 effective date of this Act if any element of the offense was
3333 committed before that date.
3434 SECTION 3. This Act takes effect September 1, 2011.
