99 AN ACT
1010 relating to who may participate in certain local option elections
1111 to prohibit or authorize the sale of alcoholic beverages.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 501, Election Code, is
1414 amended by adding Section 501.1035 to read as follows:
1515 Sec. 501.1035. ELECTION IN TERRITORY ANNEXED BY
1616 MUNICIPALITY. A municipality that includes an area annexed to the
1717 municipality on or after the date on which a petition requesting a
1818 local option election in the municipality is filed may hold the
1919 election in the municipality only if the petition contains a
2020 sufficient number of signatures to meet the requirements of Section
2121 501.032, based on the number of qualified voters in the
2222 municipality, including the annexed area. The qualified voters of
2323 the annexed area must be allowed to vote in the local option
2424 election. The results of the election shall determine the local
2525 option status of the municipality, including the annexed area.
2626 SECTION 2. This Act takes effect September 1, 2011.
