99 AN ACT
1010 relating to the applicability of the law on the consequences of a
1111 criminal conviction to law enforcement officer license holders and
1212 applicants.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 53.002, Occupations Code, is amended to
1515 read as follows:
1616 Sec. 53.002. APPLICABILITY OF CHAPTER. This chapter does
1717 not apply to:
1818 (1) the Supreme Court of Texas, a person licensed
1919 under the court's authority on behalf of the judicial department of
2020 government, or an applicant for a license issued under the court's
2121 authority on behalf of the judicial department of government;
2222 (2) a person licensed [peace officer] or an applicant
2323 for a license under Chapter 1701 [as a peace officer described by
2424 Article 2.12, Code of Criminal Procedure];
2525 (3) an applicant for certification as emergency
2626 medical services personnel under Chapter 773, Health and Safety
2727 Code; or
2828 (4) a person who:
2929 (A) is licensed by the Texas Medical Board, the
3030 Texas State Board of Pharmacy, the State Board of Dental Examiners,
3131 or the State Board of Veterinary Medical Examiners; and
3232 (B) has been convicted of a felony under Chapter
3333 481 or 483 or Section 485.033, Health and Safety Code.
3434 SECTION 2. This Act takes effect September 1, 2011.
