99 relating to enhancing the penalty prescribed for certain acts of
1010 official oppression.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 39.03, Penal Code, is amended by
1313 amending Subsection (d) and adding Subsection (e) to read as
1414 follows:
1515 (d) An offense under this section is a Class A misdemeanor,
1616 unless at the time of the commission of the offense the actor was a
1717 licensed peace officer and the actor intentionally or knowingly
1818 caused bodily injury to another, in which event it is a felony of
1919 the third degree.
2020 (e) If conduct constituting an offense under this section
2121 also constitutes an offense under another section of this code, the
2222 actor may be prosecuted under either section or both sections.
2323 SECTION 2. The change in law made by this Act applies only
2424 to an offense committed on or after the effective date of this Act.
2525 An offense committed before the effective date of this Act is
2626 covered by the law in effect when the offense was committed, and the
2727 former law is continued in effect for that purpose. For purposes of
2828 this section, an offense was committed before the effective date of
2929 this Act if any element of the offense occurred before that date.
3030 SECTION 3. This Act takes effect September 1, 2011.
