11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 39.03, Penal Code, is amended by | |
13 | 13 | amending Subsection (d) and adding Subsection (e) to read as | |
14 | 14 | follows: | |
15 | 15 | (d) An offense under this section is a Class A misdemeanor, | |
16 | 16 | unless at the time of the commission of the offense the actor was a | |
17 | 17 | licensed peace officer and the actor intentionally or knowingly | |
18 | 18 | caused bodily injury to another, in which event it is a felony of | |
19 | 19 | the third degree. | |
20 | 20 | (e) If conduct constituting an offense under this section | |
21 | 21 | also constitutes an offense under another section of this code, the | |
22 | 22 | actor may be prosecuted under either section or both sections. | |
23 | 23 | SECTION 2. The change in law made by this Act applies only | |
24 | 24 | to an offense committed on or after the effective date of this Act. | |
25 | 25 | An offense committed before the effective date of this Act is | |
26 | 26 | covered by the law in effect when the offense was committed, and the | |
27 | 27 | former law is continued in effect for that purpose. For purposes of | |
28 | 28 | this section, an offense was committed before the effective date of | |
29 | 29 | this Act if any element of the offense occurred before that date. | |
30 | 30 | SECTION 3. This Act takes effect September 1, 2011. |
