13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 32.51(a)(1), Penal Code, is amended to |
---|
15 | 15 | | read as follows: |
---|
16 | 16 | | (1) "Identifying information" means information that |
---|
17 | 17 | | alone or in conjunction with other information identifies a person, |
---|
18 | 18 | | including a person's: |
---|
19 | 19 | | (A) name and [social security number,] date of |
---|
20 | 20 | | birth[, or government-issued identification number]; |
---|
21 | 21 | | (B) unique biometric data, including the |
---|
22 | 22 | | person's fingerprint, voice print, or retina or iris image; |
---|
23 | 23 | | (C) unique electronic identification number, |
---|
24 | 24 | | address, routing code, or financial institution account number; |
---|
25 | 25 | | [and] |
---|
26 | 26 | | (D) telecommunication identifying information or |
---|
27 | 27 | | access device; and |
---|
28 | 28 | | (E) social security number or other |
---|
29 | 29 | | government-issued identification number. |
---|
30 | 30 | | SECTION 2. The change in law made by this Act applies only |
---|
31 | 31 | | to an offense committed on or after the effective date of this Act. |
---|
32 | 32 | | An offense committed before the effective date of this Act is |
---|
33 | 33 | | governed by the law in effect on the date the offense was committed, |
---|
34 | 34 | | and the former law is continued in effect for that purpose. For |
---|
35 | 35 | | purposes of this section, an offense was committed before the |
---|
36 | 36 | | effective date of this Act if any element of the offense occurred |
---|
37 | 37 | | before that date. |
---|
38 | 38 | | SECTION 3. This Act takes effect September 1, 2011. |
