99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the offense of fraudulent use or possession of
1212 identifying information.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 32.51(a)(1), Penal Code, is amended to
1515 read as follows:
1616 (1) "Identifying information" means information that
1717 alone or in conjunction with other information identifies a person,
1818 including a person's:
1919 (A) name and [social security number,] date of
2020 birth[, or government-issued identification number];
2121 (B) unique biometric data, including the
2222 person's fingerprint, voice print, or retina or iris image;
2323 (C) unique electronic identification number,
2424 address, routing code, or financial institution account number;
2525 [and]
2626 (D) telecommunication identifying information or
2727 access device; and
2828 (E) social security number or other
2929 government-issued identification number.
3030 SECTION 2. The change in law made by this Act applies only
3131 to an offense committed on or after the effective date of this Act.
3232 An offense committed before the effective date of this Act is
3333 governed by the law in effect on the date the offense was committed,
3434 and the former law is continued in effect for that purpose. For
3535 purposes of this section, an offense was committed before the
3636 effective date of this Act if any element of the offense occurred
3737 before that date.
3838 SECTION 3. This Act takes effect September 1, 2011.
