99 AN ACT
1010 relating to participation in state travel service contracts by
1111 open-enrollment charter schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 2171.055(f), Government Code, is amended
1414 to read as follows:
1515 (f) An officer or employee of a public junior college, as
1616 defined by Section 61.003, Education Code, of an open-enrollment
1717 charter school established under Subchapter D, Chapter 12,
1818 Education Code, or of a school district who is engaged in official
1919 business may participate in the commission's contract for travel
2020 services. The commission may charge a participating public junior
2121 college, open-enrollment charter school, or school district a fee
2222 not to exceed the costs incurred by the commission in providing
2323 services under this subsection. The commission shall periodically
2424 review fees and shall adjust them as needed to ensure recovery of
2525 costs incurred in providing services to public junior colleges,
2626 open-enrollment charter schools, and school districts under this
2727 subsection. The commission shall deposit the fees collected under
2828 this subsection to the credit of the public education travel
2929 account. The public education travel account is an account in the
3030 general revenue fund that may be appropriated only for the purposes
3131 of this chapter. The commission shall adopt rules and make or amend
3232 contracts as necessary to administer this subsection.
3333 SECTION 2. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2011.
