12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 2171.055(f), Government Code, is amended |
---|
14 | 14 | | to read as follows: |
---|
15 | 15 | | (f) An officer or employee of a public junior college, as |
---|
16 | 16 | | defined by Section 61.003, Education Code, of an open-enrollment |
---|
17 | 17 | | charter school established under Subchapter D, Chapter 12, |
---|
18 | 18 | | Education Code, or of a school district who is engaged in official |
---|
19 | 19 | | business may participate in the commission's contract for travel |
---|
20 | 20 | | services. The commission may charge a participating public junior |
---|
21 | 21 | | college, open-enrollment charter school, or school district a fee |
---|
22 | 22 | | not to exceed the costs incurred by the commission in providing |
---|
23 | 23 | | services under this subsection. The commission shall periodically |
---|
24 | 24 | | review fees and shall adjust them as needed to ensure recovery of |
---|
25 | 25 | | costs incurred in providing services to public junior colleges, |
---|
26 | 26 | | open-enrollment charter schools, and school districts under this |
---|
27 | 27 | | subsection. The commission shall deposit the fees collected under |
---|
28 | 28 | | this subsection to the credit of the public education travel |
---|
29 | 29 | | account. The public education travel account is an account in the |
---|
30 | 30 | | general revenue fund that may be appropriated only for the purposes |
---|
31 | 31 | | of this chapter. The commission shall adopt rules and make or amend |
---|
32 | 32 | | contracts as necessary to administer this subsection. |
---|
33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
---|
34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
---|
35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
---|
37 | 37 | | Act takes effect September 1, 2011. |
