| 11 | 11 | SECTION 1. Section 486.005, Health and Safety Code, is | |
| 12 | 12 | amended by amending Subsection (b) and adding Subsection (b-1) to | |
| 13 | 13 | read as follows: | |
| 14 | 14 | (b) Except as provided by Subsection (b-1), this [This] | |
| 15 | 15 | chapter preempts and supersedes a local ordinance, rule, or | |
| 16 | 16 | regulation adopted by a political subdivision of this state | |
| 17 | 17 | pertaining to over-the-counter sales of products that contain | |
| 18 | 18 | ephedrine, pseudoephedrine, or norpseudoephedrine. | |
| 19 | 19 | (b-1) This section does not preclude a political | |
| 20 | 20 | subdivision from adopting an ordinance, rule, or regulation | |
| 21 | 21 | authorizing or requiring a business establishment in that political | |
| 22 | 22 | subdivision that engages in over-the-counter sales of products | |
| 23 | 23 | containing ephedrine, pseudoephedrine, or norpseudoephedrine to | |
| 24 | 24 | use an electronic reporting database in addition to any other | |
| 25 | 25 | reporting or recordkeeping required under this chapter. | |
| 26 | 26 | SECTION 2. This Act takes effect September 1, 2011. |
