77 relating to the use of alternate electronic reporting databases for

1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 486.005, Health and Safety Code, is
1212 amended by amending Subsection (b) and adding Subsection (b-1) to
1313 read as follows:
1414 (b) Except as provided by Subsection (b-1), this [This]
1515 chapter preempts and supersedes a local ordinance, rule, or
1616 regulation adopted by a political subdivision of this state
1717 pertaining to over-the-counter sales of products that contain
1818 ephedrine, pseudoephedrine, or norpseudoephedrine.
1919 (b-1) This section does not preclude a political
2020 subdivision from adopting an ordinance, rule, or regulation
2121 authorizing or requiring a business establishment in that political
2222 subdivision that engages in over-the-counter sales of products
2323 containing ephedrine, pseudoephedrine, or norpseudoephedrine to
2424 use an electronic reporting database in addition to any other
2525 reporting or recordkeeping required under this chapter.
2626 SECTION 2. This Act takes effect September 1, 2011.
