A BILL TO BE ENTITLED
AN ACT
relating to the use of alternate electronic reporting databases for
over-the-counter sales of ephedrine, pseudoephedrine, and
norpseudoephedrine.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 486.005, Health and Safety Code, is
amended by amending Subsection (b) and adding Subsection (b-1) to
read as follows:
(b) Except as provided by Subsection (b-1), this [This]
chapter preempts and supersedes a local ordinance, rule, or
regulation adopted by a political subdivision of this state
pertaining to over-the-counter sales of products that contain
ephedrine, pseudoephedrine, or norpseudoephedrine.
(b-1) This section does not preclude a political
subdivision from adopting an ordinance, rule, or regulation
authorizing or requiring a business establishment in that political
subdivision that engages in over-the-counter sales of products
containing ephedrine, pseudoephedrine, or norpseudoephedrine to
use an electronic reporting database in addition to any other
reporting or recordkeeping required under this chapter.
SECTION 2. This Act takes effect September 1, 2011.
