99 AN ACT
1010 relating to the employment of an elections administrator.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The legislature finds that the powers of a county
1313 election commission or a joint elections commission extend no
1414 further than to the appointment, acceptance of resignation, or
1515 recommendation for termination of a county elections administrator
1616 or joint elections administrator.
1717 SECTION 2. Section 31.033, Election Code, is amended by
1818 adding Subsection (d) to read as follows:
1919 (d) Meetings of the county election commission are subject
2020 to Chapter 551, Government Code. In addition to posting notice as
2121 required by Chapter 551, Government Code, the commission shall
2222 provide personal written notice of a commission meeting to the
2323 county elections administrator in the time prescribed by Section
2424 551.043, Government Code, for providing public notice.
2525 SECTION 3. Section 31.155, Election Code, is amended by
2626 adding Subsection (d) to read as follows:
2727 (d) Meetings of the joint elections commission are subject
2828 to Chapter 551, Government Code. In addition to posting notice as
2929 required by Chapter 551, Government Code, the commission shall
3030 provide personal written notice of a commission meeting to the
3131 joint elections administrator in the time prescribed by Section
3232 551.043, Government Code, for providing public notice.
3333 SECTION 4. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2011.
