99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to parking placards for vehicles of persons with
1212 disabilities.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 681.003, Transportation Code, is amended
1515 by amending Subsections (b) and (e) and adding Subsection (h) to
1616 read as follows:
1717 (b) An application for a disabled parking placard must be:
1818 (1) on a form furnished by the department;
1919 (2) submitted to the county assessor-collector of the
2020 county:
2121 (A) in which the person with the disability
2222 resides if the person has a permanent disability; or
2323 (B) in which the person with the disability
2424 resides or is being treated at a medical facility if the person has
2525 a temporary disability; and
2626 (3) accompanied by a fee of $5 if the application is
2727 for a temporary placard.
2828 (e) If a first application for a disabled parking placard
2929 under this section is made by or on behalf of a person with:
3030 (1) a mobility problem caused by a disorder of the
3131 foot, the notarized written statement or written prescription
3232 required by Subsection (c) may be issued by a person licensed to
3333 practice podiatry in this state or a state adjacent to this state;
3434 [or]
3535 (2) a disability caused by an impairment of vision as
3636 provided by Section 681.001(2), the notarized written statement or
3737 written prescription required by Subsection (c) may be issued by a
3838 person licensed to engage in the practice of optometry or the
3939 practice of therapeutic optometry in this state or a state adjacent
4040 to this state; or
4141 (3) a temporary mobility problem that substantially
4242 impairs the person's ability to ambulate, the notarized written
4343 statement or written prescription required by Subsection (c) may be
4444 issued by a person licensed to practice chiropractic in this state
4545 or a state adjacent to this state.
4646 (h) In this section, "chiropractic" has the meaning
4747 assigned by Section 201.002, Occupations Code.
4848 SECTION 2. This Act takes effect September 1, 2011.
