99 AN ACT
1010 relating to the establishment of the Specialty Courts Advisory
1111 Council.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 772, Government Code, is amended by
1414 adding Section 772.0061 to read as follows:
1515 Sec. 772.0061. SPECIALTY COURTS ADVISORY COUNCIL. (a) In
1616 this section:
1717 (1) "Council" means the Specialty Courts Advisory
1818 Council.
1919 (2) "Specialty court" means:
2020 (A) a drug court program established under
2121 Chapter 469, Health and Safety Code;
2222 (B) a mental health court program established
2323 under Chapter 616, Health and Safety Code; and
2424 (C) a veterans court program established under
2525 Chapter 617, Health and Safety Code.
2626 (b) The governor shall establish the Specialty Courts
2727 Advisory Council within the criminal justice division established
2828 under Section 772.006 to evaluate applications for grant funding
2929 for specialty courts in this state and to make funding
3030 recommendations to the criminal justice division.
3131 (c) The council is composed of seven members appointed by
3232 the governor as follows:
3333 (1) three members with experience as judges of a
3434 specialty court; and
3535 (2) four members who represent the public.
3636 (d) The members appointed under Subsection (c)(2) must:
3737 (1) reside in various geographic regions of the state;
3838 and
3939 (2) have experience practicing law in a specialty
4040 court or possess knowledge and expertise in a field relating to
4141 behavioral or mental health issues or to substance abuse treatment.
4242 (e) Members are appointed for staggered six-year terms. The
4343 terms of either two or three members, as applicable, expire
4444 February 1 of each odd-numbered year.
4545 (f) A person may not be a member of the council if the person
4646 is required to register as a lobbyist under Chapter 305 because of
4747 the person's activities for compensation on behalf of a profession
4848 related to the operation of the council.
4949 (g) If a vacancy occurs on the council, the governor shall
5050 appoint a person to serve for the remainder of the unexpired term.
5151 (h) The council shall select a presiding officer.
5252 (i) The council shall meet at the call of its presiding
5353 officer or at the request of the governor.
5454 SECTION 2. Not later than February 1, 2012, the governor
5555 shall appoint the members of the Specialty Courts Advisory Council
5656 created by Section 772.0061, Government Code, as added by this Act.
5757 The governor shall appoint two members to terms expiring February
5858 1, 2013, two members to terms expiring February 1, 2015, and three
5959 members to terms expiring February 1, 2017.
6060 SECTION 3. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2011.
