10 | 10 | | relating to the regulation of the practice of engineering by |

11 | 11 | | individuals engaged in the evaluation of oil and gas resources. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
13 | 13 | | SECTION 1. Subchapter B, Chapter 1001, Occupations Code, is |
---|
14 | 14 | | amended by adding Section 1001.068 to read as follows: |
---|
15 | 15 | | Sec. 1001.068. CERTAIN OUT-OF-STATE ENGINEERS ENGAGED IN |
---|
16 | 16 | | EVALUATING OIL AND GAS RESOURCES. (a) In this section, "evaluation |
---|
17 | 17 | | of oil and gas resources" includes: |
---|
18 | 18 | | (1) the quantification of the volume of oil and gas |
---|
19 | 19 | | reserves and resources in the subsurface of the earth; |
---|
20 | 20 | | (2) the determination of production forecasts for the |
---|
21 | 21 | | reserves or resources; and |
---|
22 | 22 | | (3) the evaluation of the economic impact of the |
---|
23 | 23 | | production forecasts. |
---|
24 | 24 | | (b) This chapter does not apply to the evaluation of oil and |
---|
25 | 25 | | gas resources if the evaluation: |
---|
26 | 26 | | (1) is done by an engineer licensed in a state that |
---|
27 | 27 | | does not prohibit engineers licensed under this chapter from |
---|
28 | 28 | | engaging in the evaluation of oil and gas resources in that state; |
---|
29 | 29 | | (2) does not involve design, construction, or |
---|
30 | 30 | | engineering assessments on the surface; and |
---|
31 | 31 | | (3) does not present a risk to public health or safety. |
---|
32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
---|
33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
---|
34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
---|
36 | 36 | | Act takes effect September 1, 2011. |
