99 AN ACT
1010 relating to the regulation of the practice of engineering by
1111 individuals engaged in the evaluation of oil and gas resources.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 1001, Occupations Code, is
1414 amended by adding Section 1001.068 to read as follows:
1515 Sec. 1001.068. CERTAIN OUT-OF-STATE ENGINEERS ENGAGED IN
1616 EVALUATING OIL AND GAS RESOURCES. (a) In this section, "evaluation
1717 of oil and gas resources" includes:
1818 (1) the quantification of the volume of oil and gas
1919 reserves and resources in the subsurface of the earth;
2020 (2) the determination of production forecasts for the
2121 reserves or resources; and
2222 (3) the evaluation of the economic impact of the
2323 production forecasts.
2424 (b) This chapter does not apply to the evaluation of oil and
2525 gas resources if the evaluation:
2626 (1) is done by an engineer licensed in a state that
2727 does not prohibit engineers licensed under this chapter from
2828 engaging in the evaluation of oil and gas resources in that state;
2929 (2) does not involve design, construction, or
3030 engineering assessments on the surface; and
3131 (3) does not present a risk to public health or safety.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2011.
