1010 relating to the regulation of handfishing.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 66, Parks and Wildlife
1313 Code, is amended by adding Section 66.115 to read as follows:
1414 Sec. 66.115. HANDFISHING. (a) In this section,
1515 "handfishing" means fishing for catfish by the use of hands only and
1616 without any other fishing device such as a gaff, pole hook, trap, or
1717 spear.
1818 (b) A person holding the required fishing license and
1919 freshwater fishing stamp issued to the person by the department may
2020 engage in handfishing in the public fresh water of this state.
2121 (c) The commission may adopt rules related to handfishing.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2011.
