88 AN ACT
99 relating to certain contracts entered into by school districts for
1010 another entity to provide food services at one or more district
1111 schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 44.031, Education Code, is amended by
1414 adding Subsection (n) to read as follows:
1515 (n) A school district contract to which Subsection (a)
1616 applies under which the district contracts with another entity for
1717 that entity to manage or otherwise provide food services at one or
1818 more district schools must require that any other contract the
1919 entity makes in performance of its duties under the contract with
2020 the district and to which Subsection (a) would apply if the district
2121 were making the contract be made:
2222 (1) under the method listed by Subsection (a) that
2323 provides the best value to the entity and the district;
2424 (2) with consideration of the factors specified under
2525 Subsection (b) and, as applicable, under Subsection (b-1), in
2626 determining to whom to award the contract; and
2727 (3) as provided by Subsection (g).
2828 SECTION 2. Section 44.031(n), Education Code, as added by
2929 this Act, applies only to a contract entered into on or after the
3030 effective date of this Act by a school district with another entity
3131 for that entity to manage or otherwise provide food services at one
3232 or more district schools. A contract entered into before the
3333 effective date of this Act by a school district with another entity
3434 for that entity to manage or otherwise provide food services at one
3535 or more district schools is governed by the law in effect on the
3636 date the contract was entered into, and that law is continued in
3737 effect for that purpose.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2011.
