| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | Code, is amended by adding Chapter 8370 to read as follows: |

| 16 | 16 | | CHAPTER 8370. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 112 |

| 17 | 17 | | SUBCHAPTER A. GENERAL PROVISIONS |
|---|
| 18 | 18 | | Sec. 8370.001. DEFINITION. In this chapter, "district" |
|---|
| 19 | 19 | | means the Montgomery County Municipal Utility District No. 112. |

| 21 | 21 | | SUBCHAPTER B. POWERS AND DUTIES |

| 22 | 22 | | Sec. 8370.101. MUNICIPAL UTILITY DISTRICT POWERS AND |

| 23 | 23 | | DUTIES. The district has the powers and duties provided by the |
|---|
| 24 | 24 | | general law of this state, including Chapters 49 and 54, Water Code, |
|---|
| 25 | 25 | | applicable to municipal utility districts created under Section 59, |
|---|
| 26 | 26 | | Article XVI, Texas Constitution. |

| 27 | 27 | | Sec. 8370.102. NO ALLOCATION AGREEMENT. Section 54.016(f), |
|---|
| 28 | 28 | | Water Code, does not apply to the district. |
|---|
| 29 | 29 | | SECTION 2. (a) The legal notice of the intention to |
|---|
| 30 | 30 | | introduce this Act, setting forth the general substance of this |
|---|
| 31 | 31 | | Act, has been published as provided by law, and the notice and a |
|---|
| 32 | 32 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 33 | 33 | | officials, or entities to which they are required to be furnished |
|---|
| 34 | 34 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 35 | 35 | | Government Code. |
|---|
| 36 | 36 | | (b) The governor, one of the required recipients, has |
|---|
| 37 | 37 | | submitted the notice and Act to the Texas Commission on |
|---|
| 38 | 38 | | Environmental Quality. |
|---|
| 39 | 39 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 40 | 40 | | its recommendations relating to this Act with the governor, the |
|---|
| 41 | 41 | | lieutenant governor, and the speaker of the house of |
|---|
| 42 | 42 | | representatives within the required time. |
|---|
| 43 | 43 | | (d) All requirements of the constitution and laws of this |
|---|
| 44 | 44 | | state and the rules and procedures of the legislature with respect |
|---|
| 45 | 45 | | to the notice, introduction, and passage of this Act are fulfilled |
|---|
| 46 | 46 | | and accomplished. |

| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2011. |
