LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION April 13, 2011 TO: Honorable Garnet Coleman, Chair, House Committee on County Affairs FROM: John S O'Brien, Director, Legislative Budget Board IN RE:HB2348 by Larson (Relating to certain standards applicable to certain prisoners confined in a county jail pending transfer to the Texas Department of Criminal Justice.), As Introduced No significant fiscal implication to the State is anticipated. The bill would amend the Government Code to remove the authority of the Texas Commission on Jail Standards (TCJS) to adopt a rule that establishes classification requirements and minimum standards for certain prisoners awaiting transfer to a facility operated by or under contract with the Texas Department of Criminal Justice (TDCJ). The bill would authorize a sheriff to establish the classification requirements and minimum housing standards for prisoners that must meet or exceed current standards for inmates imprisoned in a facility operated by or under contract with TDCJ. The Commission on Jails Standards anticipates costs of approximately $40,000 per year as a result of prolonged inspections anticipated by the provisions of the bill. Local Government Impact No significant fiscal implication to units of local government is anticipated. The Travis County Sheriff's Office reported the Sheriff's Office currently has procedures that exceed the requirements by TDCJ; therefore, no fiscal impact is anticipated. The Harris County Sheriff's Office reported the bill would not require changes in current procedures; therefore, no fiscal impact is anticipated.
