| 13 | 13 | SECTION 1. Chapter 511, Government Code, is amended by | |
| 14 | 14 | adding Section 511.0089 to read as follows: | |
| 15 | 15 | Sec. 511.0089. PRISONERS AWAITING TRANSFER: CLASSIFICATION | |
| 16 | 16 | AND HOUSING. Notwithstanding Section 511.009(a), the commission | |
| 17 | 17 | may not adopt a rule that establishes classification requirements | |
| 18 | 18 | and minimum housing standards for any prisoner who is awaiting | |
| 19 | 19 | transfer to a facility operated by or under contract with the Texas | |
| 20 | 20 | Department of Criminal Justice following conviction of a felony or | |
| 21 | 21 | revocation of community supervision, parole, or mandatory | |
| 22 | 22 | supervision and for whom all paperwork and processing under Section | |
| 23 | 23 | 8(a), Article 42.09, Code of Criminal Procedure, for transfer has | |
| 24 | 24 | been completed. | |
| 25 | 25 | SECTION 2. This Act takes effect September 1, 2011. |
