1010 relating to the DNA database at the University of North Texas Health
1111 Science Center at Fort Worth.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 63, Code of Criminal
1414 Procedure, is amended by adding Article 63.0515 to read as follows:
1515 Art. 63.0515. CRIMINAL JUSTICE AGENCY. For purposes of
1616 this subchapter, the center is a criminal justice agency that
1717 performs forensic DNA analyses on evidence, including evidence
1818 related to a case involving unidentified human remains or a
1919 high-risk missing person. The center shall comply with 42 U.S.C.
2020 Section 14132.
2121 SECTION 2. Article 63.052(b), Code of Criminal Procedure,
2222 is amended to read as follows:
2323 (b) The [sole purpose of the] database may be used [is] to
2424 identify unidentified human remains and high-risk missing persons.
2525 SECTION 3. Article 63.052(c), Code of Criminal Procedure,
2626 is repealed.
2727 SECTION 4. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2011.
