77 relating to the offense of paying or receiving certain forms of
88 compensation for facilitating the registration of voters;
99 providing criminal penalties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 13, Election Code, is
1212 amended by adding Section 13.008 to read as follows:
1313 Sec. 13.008. PERFORMANCE-BASED COMPENSATION FOR
1414 REGISTERING VOTERS PROHIBITED. (a) A person commits an offense if
1515 the person:
1616 (1) compensates another person based on the number of
1717 voter registrations that the other person successfully
1818 facilitates;
1919 (2) presents another person with a quota of voter
2020 registrations to facilitate as a condition of payment or
2121 employment;
2222 (3) engages in another practice that causes another
2323 person's compensation from or employment status with the person to
2424 be dependent on the number of voter registrations that the other
2525 person facilitates; or
2626 (4) accepts compensation for an activity described by
2727 Subdivision (1), (2), or (3).
2828 (b) An offense under this section is a Class A misdemeanor.
2929 (c) An officer, director, or other agent of an entity that
3030 commits an offense under this section is punishable for the
3131 offense.
3232 SECTION 2. Section 13.036(a), Election Code, is amended to
3333 read as follows:
3434 (a) An appointment as a volunteer deputy registrar is
3535 terminated on:
3636 (1) the expiration of the volunteer deputy's term of
3737 appointment; or
3838 (2) the final conviction of the volunteer deputy for
3939 an offense prescribed by Section 13.008 or 13.043.
4040 SECTION 3. This Act takes effect September 1, 2011.
