| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 13, Election Code, is |
|---|
| 12 | 12 | | amended by adding Section 13.008 to read as follows: |
|---|
| 13 | 13 | | Sec. 13.008. PERFORMANCE-BASED COMPENSATION FOR |
|---|
| 14 | 14 | | REGISTERING VOTERS PROHIBITED. (a) A person commits an offense if |
|---|
| 15 | 15 | | the person: |
|---|
| 16 | 16 | | (1) compensates another person based on the number of |
|---|
| 17 | 17 | | voter registrations that the other person successfully |
|---|
| 18 | 18 | | facilitates; |
|---|
| 19 | 19 | | (2) presents another person with a quota of voter |
|---|
| 20 | 20 | | registrations to facilitate as a condition of payment or |
|---|
| 21 | 21 | | employment; |
|---|
| 22 | 22 | | (3) engages in another practice that causes another |
|---|
| 23 | 23 | | person's compensation from or employment status with the person to |
|---|
| 24 | 24 | | be dependent on the number of voter registrations that the other |
|---|
| 25 | 25 | | person facilitates; or |
|---|
| 26 | 26 | | (4) accepts compensation for an activity described by |
|---|
| 27 | 27 | | Subdivision (1), (2), or (3). |
|---|
| 28 | 28 | | (b) An offense under this section is a Class A misdemeanor. |
|---|
| 29 | 29 | | (c) An officer, director, or other agent of an entity that |
|---|
| 30 | 30 | | commits an offense under this section is punishable for the |
|---|
| 31 | 31 | | offense. |
|---|
| 32 | 32 | | SECTION 2. Section 13.036(a), Election Code, is amended to |
|---|
| 33 | 33 | | read as follows: |
|---|
| 34 | 34 | | (a) An appointment as a volunteer deputy registrar is |
|---|
| 35 | 35 | | terminated on: |
|---|
| 36 | 36 | | (1) the expiration of the volunteer deputy's term of |
|---|
| 37 | 37 | | appointment; or |
|---|
| 38 | 38 | | (2) the final conviction of the volunteer deputy for |
|---|
| 39 | 39 | | an offense prescribed by Section 13.008 or 13.043. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect September 1, 2011. |
