 A BILL TO BE ENTITLED
 AN ACT
 relating to the imposition of a privilege fee for state-owned
 housing provided to certain state employees by a state agency.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter E, Chapter 31, Natural Resources
 Code, is amended by adding Section 31.1531 to read as follows:
 Sec. 31.1531.  STATE-OWNED HOUSING.  (a)  This section does
 not apply to:
 (1)  the Governor's Mansion;
 (2)  the State Capitol;
 (3)  state employee dormitory housing; or
 (4)  a state agency the real property of which is
 governed by Section 31.155(d).
 (b)  Not later than September 1 of each year, the land office
 shall:
 (1)  determine the fair market rental value of
 state-owned housing provided to a state employee by a state agency;
 and
 (2)  notify each state agency that provides state-owned
 housing to state employees of the fair market rental value of the
 employee housing provided by that state agency.
 (c)  A state agency that provides state-owned housing to a
 state employee and does not recover 100 percent of the determined
 fair market rental value of the housing from the employee shall
 require as a condition of occupancy that the employee remit a
 monthly privilege fee to the school district in which the
 state-owned housing is located not later than the first day of each
 month that the employee occupies the housing.
 (d)  A monthly privilege fee under this section is equal to
 20 percent of the difference between the fair market rental value of
 the housing provided to an employee determined under Subsection (b)
 and the amount, if any, paid by the employee for the housing.
 (e)  A state agency shall immediately remove an employee
 required to make a monthly privilege fee from the state housing
 occupied by the employee if the employee does not remit the fee by
 the third day of the month.
 SECTION 2.  The changes in law made by this Act apply only to
 a monthly privilege fee due on or after October 1, 2011.
 SECTION 3.  This Act takes effect September 1, 2011.
