99 AN ACT
1010 relating to the procedure for providing a copy of the final decree
1111 of dissolution of a marriage to a party who waived service of
1212 process.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 6.710, Family Code, is amended to read as
1515 follows:
1616 Sec. 6.710. NOTICE [COPY] OF FINAL DECREE. The clerk of the
1717 court shall mail a notice of the signing [copy] of the final decree
1818 of dissolution of a marriage to the party who waived service of
1919 process under Section 6.4035 [by mailing the copy of the decree to
2020 the party] at the mailing address contained in the waiver or [to]
2121 the office of the party's attorney of record. The notice must state
2222 that a copy of the decree is available at the office of the clerk of
2323 the court and include the physical address of that office.
2424 SECTION 2. Section 6.710, Family Code, as amended by this
2525 Act, applies to a suit for dissolution of a marriage filed on or
2626 after the effective date of this Act. A suit for dissolution of a
2727 marriage filed before the effective date of this Act is governed by
2828 the law in effect on the date the suit was filed, and the former law
2929 is continued in effect for that purpose.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2011.
