77 relating to the amount of the state traffic fine.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 542.4031(a), Transportation Code, is
1010 amended to read as follows:
1111 (a) In addition to the fine prescribed by Section 542.401 or
1212 another section of this subtitle, as applicable, a person who
1313 enters a plea of guilty or nolo contendere to or is convicted of an
1414 offense under this subtitle shall pay $45 [$30] as a state traffic
1515 fine. The person shall pay the state traffic fine when the person
1616 enters the person's plea of guilty or nolo contendere, or on the
1717 date of conviction, whichever is earlier. The state traffic fine
1818 shall be paid regardless of whether:
1919 (1) a sentence is imposed on the person;
2020 (2) the court defers final disposition of the person's
2121 case; or
2222 (3) the person is placed on community supervision,
2323 including deferred adjudication community supervision.
2424 SECTION 2. The change in law made by this Act applies only
2525 to an offense committed on or after the effective date of this Act.
2626 An offense committed before the effective date of this Act is
2727 governed by the law in effect on the date the offense was committed,
2828 and the former law is continued in effect for that purpose. For
2929 purposes of this section, an offense was committed before the
3030 effective date of this Act if any element of the offense occurred
3131 before that date.
3232 SECTION 3. This Act takes effect September 1, 2011.
