9	9	relating to the formal recognition and administration of The Texas
10	10	A&M University System Health Science Center.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Subtitle D, Title 3, Education Code, is amended
13	13	by adding Chapter 89 to read as follows:
14	14	CHAPTER 89. THE TEXAS A&M UNIVERSITY SYSTEM HEALTH SCIENCE CENTER
15	15	SUBCHAPTER A. GENERAL PROVISIONS
16	16	Sec. 89.001. DEFINITIONS. In this chapter:
17	17	(1) "Board" means the board of regents of The Texas A&M
18	18	University System.
19	19	(2) "Health science center" means The Texas A&M
20	20	University System Health Science Center.
21	21	Sec. 89.002. COMPOSITION. (a) The Texas A&M University
22	22	System Health Science Center is composed of the following component
23	23	institutions, agencies, and programs under the management and
24	24	control of the board:
25	25	(1) The Texas A&M University System Health Science
26	26	Center College of Medicine;
27	27	(2) The Texas A&M University System Health Science
28	28	Center Baylor College of Dentistry;
29	29	(3) The Texas A&M University System Health Science
30	30	Center School of Rural Public Health;
31	31	(4) The Texas A&M University System Health Science
32	32	Center Irma Lerma Rangel College of Pharmacy;
33	33	(5) The Texas A&M University System Health Science
34	34	Center College of Nursing;
35	35	(6) The Texas A&M University System Health Science
36	36	Center School of Graduate Studies;
37	37	(7) The Texas A&M University System Health Science
38	38	Center Institute of Biosciences and Technology;
39	39	(8) The Texas A&M University System Health Science
40	40	Center Coastal Bend Health Education Center;
41	41	(9) The Texas A&M University System Health Science
42	42	Center South Texas Health Center; and
43	43	(10) The Texas A&M University System Health Science
44	44	Center Rural and Community Health Institute.
45	45	(b) The Texas A&M University System Health Science Center
46	46	Baylor College of Dentistry may use the name "Baylor" only:
47	47	(1) in accordance with:
48	48	(A) a license agreement between the health
49	49	science center and Baylor University; or
50	50	(B) other written approval from Baylor
51	51	University; or
52	52	(2) as otherwise permitted by law.
53	53	Sec. 89.003. MANDATORY VENUE. (a) Venue for a suit filed
54	54	against the health science center, any component institution,
55	55	agency, or program of the health science center, or any officer or
56	56	employee of the health science center is in Brazos County.
57	57	(b) This section does not waive any defense to or immunity
58	58	from suit or liability that may be asserted by an entity or
59	59	individual described by this section.
60	60	(c) In case of a conflict between this section and any other
61	61	law, this section controls.
62	62	Sec. 89.004. EXPENDITURE OF STATE FUNDS. The board is
63	63	authorized to expend funds appropriated to it by the legislature
64	64	for all lawful purposes of the health science center and its
65	65	component institutions, agencies, and programs as well as funds
66	66	available under the authority of Section 18, Article VII, Texas
67	67	Constitution, for the purposes expressed in that section for the
68	68	support of the health science center and its component
69	69	institutions, agencies, and programs.

71	71	SUBCHAPTER B. THE TEXAS A&M UNIVERSITY SYSTEM HEALTH SCIENCE
72	72	CENTER IRMA LERMA RANGEL COLLEGE OF PHARMACY
73	73	Sec. 89.051. THE TEXAS A&M UNIVERSITY SYSTEM HEALTH SCIENCE
74	74	CENTER IRMA LERMA RANGEL COLLEGE OF PHARMACY. (a) The board shall
75	75	maintain a college of pharmacy as a component of the health science
76	76	center.
77	77	(b) The college shall be known as The Texas A&M University
78	78	System Health Science Center Irma Lerma Rangel College of Pharmacy,
79	79	and the primary building in which the school is operated in Kleberg
80	80	County must include "Irma Rangel" in its official name.
81	81	SECTION 2. Section 61.003(5), Education Code, is amended to
82	82	read as follows:
83	83	(5) "Medical and dental unit" means The Texas A&M
84	84	University System Health Science Center and its component
85	85	institutions, agencies, and programs; The University of Texas
86	86	Medical Branch at Galveston; The University of Texas Southwestern
87	87	Medical Center at Dallas; The University of Texas Medical School at
88	88	San Antonio; The University of Texas Dental Branch at Houston; The
89	89	University of Texas M. D. Anderson Cancer Center; The University of
90	90	Texas Graduate School of Biomedical Sciences at Houston; The
91	91	University of Texas Dental School at San Antonio; The University of
92	92	Texas Medical School at Houston; The University of Texas Health
93	93	Science Center--South Texas and its component institutions, if
94	94	established under Subchapter N, Chapter 74; the nursing
95	95	institutions of The Texas A&M University System and The University
96	96	of Texas System; and The University of Texas School of Public Health
97	97	at Houston; and such other medical or dental schools as may be
98	98	established by statute or as provided in this chapter.
99	99	SECTION 3. The following are repealed:
100	100	(1) Subchapters D, F, G, and H, Chapter 86, Education
101	101	Code; and
102	102	(2) Subchapter I, Chapter 87, Education Code.
103	103	SECTION 4. Section 89.003, Education Code, as added by this
104	104	Act, applies only to an action brought against The Texas A&M
105	105	University System Health Science Center, a component institution,
106	106	agency, or program of that center, or an officer or employee of that
107	107	center on or after the effective date of this Act.
108	108	SECTION 5. This Act takes effect immediately if it receives
109	109	a vote of two-thirds of all the members elected to each house, as
110	110	provided by Section 39, Article III, Texas Constitution. If this
111	111	Act does not receive the vote necessary for immediate effect, this
112	112	Act takes effect September 1, 2011.
