11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. The heading to Chapter 142, Education Code, is |
---|
13 | 13 | | amended to read as follows: |

14 | 14 | | CHAPTER 142. NORMAN HACKERMAN ADVANCED RESEARCH PROGRAM |
---|
15 | 15 | | SECTION 2. Section 142.001(4), Education Code, is amended |
---|
16 | 16 | | to read as follows: |

17 | 17 | | (4) "Program" means the Norman Hackerman advanced |
---|
18 | 18 | | research program established under this chapter. |

19 | 19 | | SECTION 3. Section 142.002, Education Code, is amended to |

20 | 20 | | read as follows: |

21 | 21 | | Sec. 142.002. PURPOSE. The Norman Hackerman advanced |
---|
22 | 22 | | research program is established to encourage and provide support |
---|
23 | 23 | | for basic research conducted by faculty members and students in |
---|
24 | 24 | | astronomy, atmospheric science, biological and behavioral |
---|
25 | 25 | | sciences, chemistry, computer sciences, earth sciences, |
---|
26 | 26 | | engineering, information science, mathematics, material sciences, |
---|
27 | 27 | | oceanography, physics, environmental issues affecting the |
---|
28 | 28 | | Texas-Mexico border region, the reduction of industrial, |
---|
29 | 29 | | agricultural, and domestic water use, social sciences, and related |
---|
30 | 30 | | disciplines in eligible institutions. |

31 | 31 | | SECTION 4. Section 142.004(a), Education Code, is amended |
---|
32 | 32 | | to read as follows: |
---|
33 | 33 | | (a) The program is funded by appropriations and by gifts, |
---|
34 | 34 | | grants, and donations made for purposes of the program [that |
---|
35 | 35 | | purpose]. [The total funds appropriated to the program may be at |
---|
36 | 36 | | least equal to 10 percent of the average amount of the federally |
---|
37 | 37 | | sponsored research funds allocated to all institutions of higher |
---|
38 | 38 | | education annually during the preceding three years.] |
---|
39 | 39 | | SECTION 5. Section 142.004(b), Education Code, is repealed. |
---|
40 | 40 | | SECTION 6. This Act takes effect immediately if it receives |
---|
41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
---|
42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
---|
44 | 44 | | Act takes effect September 1, 2011. |
