99 AN ACT
1010 relating to the office of inspector general of the Texas Youth
1111 Commission.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 61.0451(b), (f), (g), and (i), Human
1414 Resources Code, are amended to read as follows:
1515 (b) The office of inspector general shall prepare and
1616 deliver a report concerning the results of any investigation
1717 conducted under this section to:
1818 (1) the board;
1919 (2) the executive commissioner;
2020 (3) [(2)] the advisory board;
2121 (4) [(3)] the governor;
2222 (5) [(4)] the lieutenant governor;
2323 (6) [(5)] the speaker of the house of representatives;
2424 (7) [(6)] the standing committees of the senate and
2525 house of representatives with primary jurisdiction over matters
2626 concerning correctional facilities;
2727 (8) [(7)] the special prosecution unit;
2828 (9) [(8)] the state auditor; and
2929 (10) [(9)] any other appropriate state agency
3030 responsible for licensing or certifying commission employees or
3131 facilities.
3232 (f) The board [executive commissioner] shall select a
3333 commissioned peace officer as chief inspector general. The chief
3434 inspector general:
3535 (1) operates directly under the authority of the
3636 board;
3737 (2) is subject to the requirements of this section;
3838 and
3939 (3) may only be discharged by the board for cause.
4040 (g) The chief inspector general shall on a quarterly basis
4141 prepare and deliver a report concerning the operations of the
4242 office of inspector general to:
4343 (1) the board;
4444 (2) the executive commissioner;
4545 (3) [(2)] the advisory board;
4646 (4) [(3)] the governor;
4747 (5) [(4)] the lieutenant governor;
4848 (6) [(5)] the speaker of the house of representatives;
4949 (7) [(6)] the standing committees of the senate and
5050 house of representatives with primary jurisdiction over
5151 correctional facilities;
5252 (8) [(7)] the state auditor; and
5353 (9) [(8)] the comptroller.
5454 (i) The office of inspector general shall immediately
5555 report to the [executive director, the] board, the governor's
5656 general counsel, and the state auditor:
5757 (1) any particularly serious or flagrant problem
5858 concerning the administration of a commission program or operation;
5959 or
6060 (2) any interference by the executive director, an
6161 employee of the commission, a facility described by Subsection
6262 (a)(2), or an officer or employee of a facility described by
6363 Subsection (a)(2) with an investigation conducted by the office.
6464 SECTION 2. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2011.
