12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Sections 61.0451(b), (f), (g), and (i), Human |
---|
14 | 14 | | Resources Code, are amended to read as follows: |
---|
15 | 15 | | (b) The office of inspector general shall prepare and |
---|
16 | 16 | | deliver a report concerning the results of any investigation |
---|
17 | 17 | | conducted under this section to: |
---|
18 | 18 | | (1) the board; |
---|
19 | 19 | | (2) the executive commissioner; |
---|
20 | 20 | | (3) [(2)] the advisory board; |
---|
21 | 21 | | (4) [(3)] the governor; |
---|
22 | 22 | | (5) [(4)] the lieutenant governor; |
---|
23 | 23 | | (6) [(5)] the speaker of the house of representatives; |
---|
24 | 24 | | (7) [(6)] the standing committees of the senate and |
---|
25 | 25 | | house of representatives with primary jurisdiction over matters |
---|
26 | 26 | | concerning correctional facilities; |
---|
27 | 27 | | (8) [(7)] the special prosecution unit; |
---|
28 | 28 | | (9) [(8)] the state auditor; and |
---|
29 | 29 | | (10) [(9)] any other appropriate state agency |
---|
30 | 30 | | responsible for licensing or certifying commission employees or |
---|
31 | 31 | | facilities. |
---|
32 | 32 | | (f) The board [executive commissioner] shall select a |
---|
33 | 33 | | commissioned peace officer as chief inspector general. The chief |
---|
34 | 34 | | inspector general: |
---|
35 | 35 | | (1) operates directly under the authority of the |
---|
36 | 36 | | board; |
---|
37 | 37 | | (2) is subject to the requirements of this section; |
---|
38 | 38 | | and |
---|
39 | 39 | | (3) may only be discharged by the board for cause. |
---|
40 | 40 | | (g) The chief inspector general shall on a quarterly basis |
---|
41 | 41 | | prepare and deliver a report concerning the operations of the |
---|
42 | 42 | | office of inspector general to: |
---|
43 | 43 | | (1) the board; |
---|
44 | 44 | | (2) the executive commissioner; |
---|
45 | 45 | | (3) [(2)] the advisory board; |
---|
46 | 46 | | (4) [(3)] the governor; |
---|
47 | 47 | | (5) [(4)] the lieutenant governor; |
---|
48 | 48 | | (6) [(5)] the speaker of the house of representatives; |
---|
49 | 49 | | (7) [(6)] the standing committees of the senate and |
---|
50 | 50 | | house of representatives with primary jurisdiction over |
---|
51 | 51 | | correctional facilities; |
---|
52 | 52 | | (8) [(7)] the state auditor; and |
---|
53 | 53 | | (9) [(8)] the comptroller. |
---|
54 | 54 | | (i) The office of inspector general shall immediately |
---|
55 | 55 | | report to the [executive director, the] board, the governor's |
---|
56 | 56 | | general counsel, and the state auditor: |
---|
57 | 57 | | (1) any particularly serious or flagrant problem |
---|
58 | 58 | | concerning the administration of a commission program or operation; |
---|
59 | 59 | | or |
---|
60 | 60 | | (2) any interference by the executive director, an |
---|
61 | 61 | | employee of the commission, a facility described by Subsection |
---|
62 | 62 | | (a)(2), or an officer or employee of a facility described by |
---|
63 | 63 | | Subsection (a)(2) with an investigation conducted by the office. |
---|
64 | 64 | | SECTION 2. This Act takes effect immediately if it receives |
---|
65 | 65 | | a vote of two-thirds of all the members elected to each house, as |
---|
66 | 66 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
67 | 67 | | Act does not receive the vote necessary for immediate effect, this |
---|
68 | 68 | | Act takes effect September 1, 2011. |
