99 AN ACT
1010 relating to the regulation of orthotists and prosthetists.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 605.002(14) and (18), Occupations Code,
1313 are amended to read as follows:
1414 (14) "Orthotics" means the science and practice of
1515 measuring, designing, fabricating, assembling, fitting, adjusting,
1616 or servicing an orthosis under an order from a licensed physician,
1717 chiropractor, or podiatrist, or an advanced practice nurse or
1818 physician assistant acting under the delegation and supervision of
1919 a licensed physician as provided by Subchapter B, Chapter 157, and
2020 rules adopted by the Texas Medical Board, for the correction or
2121 alleviation of a neuromuscular or musculoskeletal dysfunction,
2222 disease, injury, or deformity.
2323 (18) "Prosthetics" means the science and practice of
2424 measuring, designing, fabricating, assembling, fitting, adjusting,
2525 or servicing a prosthesis under an order from a licensed physician,
2626 chiropractor, or podiatrist, or an advanced practice nurse or
2727 physician assistant acting under the delegation and supervision of
2828 a licensed physician as provided by Subchapter B, Chapter 157, and
2929 rules adopted by the Texas Medical Board.
3030 SECTION 2. Section 605.2515, Occupations Code, is amended
3131 to read as follows:
3232 Sec. 605.2515. ADDITIONAL LICENSE: DEVICE MANUFACTURER. A
3333 person licensed to practice orthotics or prosthetics who measures,
3434 designs, fabricates, fits, assembles, adjusts, or services an
3535 orthosis or a prosthesis under an order from a licensed physician,
3636 chiropractor, or podiatrist, or an advanced practice nurse or
3737 physician assistant acting under the delegation and supervision of
3838 a licensed physician as provided by Subchapter B, Chapter 157, and
3939 rules adopted by the Texas Medical Board, for a specific patient is
4040 exempt from licensing as a device manufacturer under Subchapter L,
4141 Chapter 431, Health and Safety Code. A person licensed to practice
4242 orthotics or prosthetics who fabricates or assembles an orthosis or
4343 a prosthesis without an order from a licensed physician,
4444 chiropractor, or podiatrist, or an advanced practice nurse or
4545 physician assistant acting under the delegation and supervision of
4646 a licensed physician as provided by Subchapter B, Chapter 157, and
4747 rules adopted by the Texas Medical Board, for a specific patient is
4848 required to be licensed as a device manufacturer under Subchapter
4949 L, Chapter 431, Health and Safety Code.
5050 SECTION 3. This Act takes effect September 1, 2011.
