1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to creation of a study committee for the Interstate Health
1414 Care Compact.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. FINDINGS. (a) The legislature finds that the
1717 Interstate Health Care Compact authorizes the legislature to
1818 suspend the operation of federal laws, rules, regulations, and
1919 orders regarding health care that are inconsistent with a state law
2020 or regulation.
2121 (b) By exercising the authority described by Subsection (a)
2222 of this section, the state assumes primary responsibility to
2323 regulate health care in this state.
2424 (c) Alternatively, the legislature may suspend a federal
2525 law, rule, regulation, or order relating to a limited area of health
2626 care.
2727 (d) By exercising the authority described by Subsection (c)
2828 of this section, the state assumes primary responsibility to
2929 regulate health care for only that limited area of health care.
3030 (e) The first step toward implementation of the Interstate
3131 Health Care Compact in this state is the creation of a study
3232 committee to make recommendations to the governor and legislature
3333 about the most efficient use of the authority provided by the
3434 Interstate Health Care Compact.
3535 SECTION 2. DEFINITIONS. In this Act:
3636 (1) "Committee" means the Texas Health Care Compact
3737 Advisory Committee.
3838 (2) "Compact" means the Interstate Health Care
3939 Compact.
4040 (3) "Health care" means care, services, supplies, or
4141 plans related to the health of an individual, including:
4242 (A) preventive, diagnostic, therapeutic,
4343 rehabilitative, maintenance, or palliative care, counseling,
4444 service, assessment, or treatment related to the physical or mental
4545 condition or function of an individual or the structure or function
4646 of the body;
4747 (B) the sale or dispensing of a drug, device,
4848 equipment, or other item in accordance with a prescription; and
4949 (C) provision or payment by an individual or
5050 group health benefit plan of the cost of care, services, or supplies
5151 related to the health of an individual. The term does not include
5252 care, services, supplies, or plans provided by the United States
5353 Department of Defense and United States Department of Veterans
5454 Affairs, or provided to Native Americans.
5555 SECTION 3. TEXAS HEALTH CARE COMPACT ADVISORY COMMITTEE.
5656 The Texas Health Care Compact Advisory Committee is established to
5757 make recommendations to the legislature and governor on the
5858 implementation of the Interstate Health Care Compact in this state.
5959 SECTION 4. MEMBERSHIP. (a) The committee is composed of 11
6060 members, appointed as follows:
6161 (1) five individuals experienced in the delivery of or
6262 payment for health care services in this state appointed by the
6363 governor;
6464 (2) three members of the senate appointed by the
6565 lieutenant governor; and
6666 (3) three members of the house of representatives
6767 appointed by the speaker of the house of representatives.
6868 (b) The members of the committee must be individuals who
6969 reflect the geographic diversity of this state.
7070 (c) Each state agency involved in the delivery or regulation
7171 of health care in this state may appoint one individual to serve on
7272 the committee in a nonvoting capacity.
7373 (d) The governor shall select the presiding officer of the
7474 committee from the membership of the committee.
7575 SECTION 5. POWERS AND DUTIES. (a) The committee shall:
7676 (1) examine the state's capability to assume
7777 regulatory authority over health care;
7878 (2) recommend:
7979 (A) the appropriate scope of authority and
8080 responsibility for the state consistent with the state's capability
8181 to assume regulatory authority over health care;
8282 (B) an organizational structure to exercise
8383 regulatory authority over health care;
8484 (C) a timetable for implementation; and
8585 (D) specific amendments to state laws and
8686 regulations that are necessary to implement the committee's
8787 recommendations under this subdivision; and
8888 (3) estimate funding requirements to implement the
8989 recommendations.
9090 (b) The committee shall hold public hearings on the state's
9191 capability to assume regulatory authority over health care.
9292 (c) The committee may adopt rules necessary to conduct
9393 business under and implement this Act.
9494 SECTION 6. SUPPORT. (a) The committee may request
9595 assistance from any state executive or legislative governmental
9696 entity.
9797 (b) The committee may solicit and accept gifts and grants
9898 for the support of the committee's activities.
9999 (c) The legislature may appropriate funds for the support of
100100 the committee's activities.
101101 (d) The committee may employ staff.
102102 SECTION 7. REPORT. Not later than December 1, 2012, the
103103 committee shall report to the governor and the legislature the
104104 recommendations made under Section 5 of this Act.
105105 SECTION 8. EXPIRATION. This Act expires August 31, 2013.
106106 SECTION 9. EFFECTIVE DATE. This Act takes effect September
107107 1, 2011, but only if Senate Bill 25 or another bill of the 82nd
108108 Legislature, Regular Session, 2011, enacting the Interstate Health
109109 Care Compact becomes law. If that bill does not become law, this Act
110110 has no effect.
