99 relating to duties of law enforcement involving damaged fences.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 370.004(a), Local Government Code, is
1212 amended to read as follows:
1313 (a) A peace officer employed by a political subdivision of
1414 this state who investigates or responds to an incident in which a
1515 motor vehicle damages a fence shall, if the peace officer
1616 reasonably believes that the fence is intended to contain livestock
1717 or other animals:
1818 (1) immediately determine the owner of the land on
1919 which the damaged fence is located; [and]
2020 (2) notify the owner of the type and extent of the
2121 damage, if the owner has registered with the political subdivision
2222 in accordance with Subsection (c); and
2323 (3) remain at the location of the damaged fence until:
2424 (A) the peace officer or another person makes
2525 reasonable attempts to secure the fence; or
2626 (B) the landowner or landowner's representative
2727 arrives at the scene.
2828 SECTION 2. This Act takes effect September 1, 2011.
