10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 370.004(a), Local Government Code, is | |
12 | 12 | amended to read as follows: | |
13 | 13 | (a) A peace officer employed by a political subdivision of | |
14 | 14 | this state who investigates or responds to an incident in which a | |
15 | 15 | motor vehicle damages a fence shall, if the peace officer | |
16 | 16 | reasonably believes that the fence is intended to contain livestock | |
17 | 17 | or other animals: | |
18 | 18 | (1) immediately determine the owner of the land on | |
19 | 19 | which the damaged fence is located; [and] | |
20 | 20 | (2) notify the owner of the type and extent of the | |
21 | 21 | damage, if the owner has registered with the political subdivision | |
22 | 22 | in accordance with Subsection (c); and | |
23 | 23 | (3) remain at the location of the damaged fence until: | |
24 | 24 | (A) the peace officer or another person makes | |
25 | 25 | reasonable attempts to secure the fence; or | |
26 | 26 | (B) the landowner or landowner's representative | |
27 | 27 | arrives at the scene. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2011. |
