99 AN ACT
1010 relating to the authority of a governing body of a Type C General
1111 Law City to adopt an ordinance to determine the manner of when
1212 commissioners run for elected office.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Chapter 24 of the Local Government Code,
1515 specifically Section 24.023 is amended to read as follows:
1616 Sec. 24.023. REGULAR TERM OF OFFICE; REGULAR ELECTION
1717 DATE. (a) The mayor and commissioners of the municipality serve
1818 for a term of two years unless a longer term is established under
1919 Article XI, Section 11, of the Texas Constitution.
2020 (b) The election for mayor and commissioners shall be held
2121 on an authorized uniform election date as provided by Chapter 41,
2222 Election Code.
2323 (c) The first regular election must be on an authorized
2424 uniform election date occurring:
2525 (1) in the case of a community incorporating as a Type
2626 C general-law municipality, within one year after the expiration of
2727 the month in which the incorporation election is held; or
2828 (2) in the case of a municipality changing to a Type C
2929 general-law municipality, within one year after the month in which
3030 the election on the change is held.
3131 (d) In a City incorporated under this Chapter with a
3232 population of over 10,000 residents, the governing body may adopt
3333 an ordinance to determine if commissioners may be elected in
3434 alternate years or in the same election year. Elections under this
3535 subsection shall be held on an authorized uniform election date as
3636 provided by Chapter 41, Election Code.
3737 SECTION 2. The change in law made by Section 1 of this Act
3838 applies only to a General Law C city with a population over 10,000.
3939 SECTION 3. This Act takes effect September 1, 2011.
