99 AN ACT
1010 relating to the composition of the Finance Commission of Texas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 11.102(b), Finance Code, is amended to
1313 read as follows:
1414 (b) One member of the finance commission must be a banking
1515 executive, one member of the finance commission must be a savings
1616 executive, one member of the finance commission must be a consumer
1717 credit executive, and one member of the finance commission must be a
1818 residential mortgage loan originator licensed under Chapter 156 or
1919 157 [broker].
2020 SECTION 2. Section 11.102(e)(4), Finance Code, is amended
2121 to read as follows:
2222 (4) "Residential mortgage loan originator" ["Mortgage
2323 broker"] means a person who:
2424 (A) has had five years' or more experience as a
2525 residential mortgage loan originator [broker], as defined by
2626 Section 180.002 [156.002], during the seven-year period preceding
2727 the person's appointment; and
2828 (B) is a residential mortgage loan originator
2929 [broker], as defined by Section 180.002 [156.002].
3030 SECTION 3. (a) A member of the Finance Commission of Texas
3131 who is a mortgage broker and who is serving on the effective date of
3232 this Act continues to serve until the expiration of the term for
3333 which the member was appointed.
3434 (b) As soon as practicable following the expiration of the
3535 term of the member described in Subsection (a) of this section or
3636 following any vacancy in that position that occurs before the
3737 expiration of the term, the governor shall make an appointment to
3838 the Finance Commission of Texas to achieve the composition
3939 prescribed by Section 11.102, Finance Code, as amended by this Act.
4040 SECTION 4. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2011.
