66 AN ACT
77 relating to the penalty for providing false information on an
88 application for a ballot to be voted by mail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 84.0041(b), Election Code, is amended to
1111 read as follows:
1212 (b) An offense under this section is a state jail felony
1313 [unless the person is the applicant, is related to the applicant
1414 within the second degree by affinity or the third degree by
1515 consanguinity, as determined under Subchapter B, Chapter 573,
1616 Government Code, or is registered to vote at the same address as the
1717 applicant, in which event the offense is a Class A misdemeanor].
1818 SECTION 2. The change in law made by this Act applies only
1919 to an offense committed on or after the effective date of this Act.
2020 An offense committed before the effective date of this Act is
2121 governed by the law in effect when the offense was committed, and
2222 the former law is continued in effect for that purpose. For
2323 purposes of this section, an offense was committed before the
2424 effective date of this Act if any element of the offense occurred
2525 before that date.
2626 SECTION 3. This Act takes effect September 1, 2011.
