| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 254.051(f), Health and Safety Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | (f) Notwithstanding Section 254.053(f), a [A] facility that |
|---|
| 16 | 16 | | is not in continuous operation 24 hours per day and 7 days per week |
|---|
| 17 | 17 | | cannot be issued a license with a term that extends beyond August |
|---|
| 18 | 18 | | 31, 2013. |

| 19 | 19 | | SECTION 2. Section 254.053(f), Health and Safety Code, is |
|---|
| 20 | 20 | | amended to read as follows: |
|---|
| 21 | 21 | | (f) The license fee must be paid [annually] on renewal of |
|---|
| 22 | 22 | | the license. The term of a license issued under this chapter is two |
|---|
| 23 | 23 | | years. |
|---|
| 24 | 24 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to a license issued or renewed on or after the effective date of |
|---|
| 26 | 26 | | this Act. A license issued or renewed before the effective date of |
|---|
| 27 | 27 | | this Act is governed by the law in effect immediately before the |
|---|
| 28 | 28 | | effective date of this Act, and that law is continued in effect for |
|---|
| 29 | 29 | | that purpose. |
|---|
| 30 | 30 | | SECTION 4. This Act takes effect September 1, 2011. |
