| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 521.293, Transportation Code, is amended |
|---|
| 13 | 13 | | by amending Subsection (a) and adding Subsection (c) to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | (a) Except as provided by Subsections [Subsection] (b) and |
|---|
| 16 | 16 | | (c), if the person does not request a hearing, the period of license |
|---|
| 17 | 17 | | suspension under Section 521.292 is 90 days. |
|---|
| 18 | 18 | | (c) The period of license suspension is 180 days if: |
|---|
| 19 | 19 | | (1) the department determines that the person engaged |
|---|
| 20 | 20 | | in conduct described by Section 521.292(a)(8); |
|---|
| 21 | 21 | | (2) the person does not request a hearing; and |
|---|
| 22 | 22 | | (3) the moving violation is a third or subsequent |
|---|
| 23 | 23 | | moving violation. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to an offense described by Section 521.292(a)(8), Transportation |
|---|
| 26 | 26 | | Code, committed on or after the effective date of this Act. An |
|---|
| 27 | 27 | | offense committed before the effective date of this Act is governed |
|---|
| 28 | 28 | | by the law in effect on the date the offense was committed, and the |
|---|
| 29 | 29 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 30 | 30 | | this section, an offense was committed before the effective date of |
|---|
| 31 | 31 | | this Act if any element of the offense occurred before that date. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2011. |
