88 AN ACT
99 relating to the period of license suspension after moving
1010 violations for a holder of a provisional driver's license.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 521.293, Transportation Code, is amended
1313 by amending Subsection (a) and adding Subsection (c) to read as
1414 follows:
1515 (a) Except as provided by Subsections [Subsection] (b) and
1616 (c), if the person does not request a hearing, the period of license
1717 suspension under Section 521.292 is 90 days.
1818 (c) The period of license suspension is 180 days if:
1919 (1) the department determines that the person engaged
2020 in conduct described by Section 521.292(a)(8);
2121 (2) the person does not request a hearing; and
2222 (3) the moving violation is a third or subsequent
2323 moving violation.
2424 SECTION 2. The change in law made by this Act applies only
2525 to an offense described by Section 521.292(a)(8), Transportation
2626 Code, committed on or after the effective date of this Act. An
2727 offense committed before the effective date of this Act is governed
2828 by the law in effect on the date the offense was committed, and the
2929 former law is continued in effect for that purpose. For purposes of
3030 this section, an offense was committed before the effective date of
3131 this Act if any element of the offense occurred before that date.
3232 SECTION 3. This Act takes effect September 1, 2011.
