99 AN ACT
1010 relating to pilot programs to implement a management methodology
1111 for the improvement of operations and reduction of costs for
1212 certain state agencies.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter D, Chapter 301, Labor Code, is
1515 amended by adding Section 301.068 to read as follows:
1616 Sec. 301.068. EFFICIENCY PILOT PROGRAM. (a) The
1717 commission shall establish a pilot program to:
1818 (1) improve the efficiency and quality of commission
1919 operations while reducing costs; and
2020 (2) adopt a structured approach for identifying the
2121 wasteful use of state resources and improving commission processes.
2222 (b) In implementing the pilot program, the commission shall
2323 use:
2424 (1) a methodology that includes a define, measure,
2525 analyze, improve, and control structure for reviewing project
2626 management;
2727 (2) a continuous improvement technique that:
2828 (A) identifies value and a value stream;
2929 (B) creates a flow for activities;
3030 (C) allows consumers to pull products or services
3131 through the process; and
3232 (D) allows for the process to be perfected over
3333 time; and
3434 (3) a measurement system analysis to evaluate data.
3535 (c) The commission shall conduct an internal performance
3636 audit to assess the effectiveness of the pilot program implemented
3737 under this section.
3838 (d) Not later than August 1, 2012, the commission shall
3939 submit a written report of the results of the performance audit to
4040 the:
4141 (1) governor;
4242 (2) lieutenant governor;
4343 (3) speaker of the house of representatives;
4444 (4) Senate Committee on Government Organization;
4545 (5) House Government Efficiency and Reform Committee;
4646 and
4747 (6) house and senate committees with primary
4848 jurisdiction over state affairs.
4949 (e) The commission shall implement the pilot program from
5050 available funds that may be used for that purpose.
5151 (f) A state agency, other than the commission, may implement
5252 the pilot program established under this section with respect to
5353 the agency. An agency that implements the pilot program shall:
5454 (1) conduct the performance audit and submit the
5555 written report in the time and manner described by Subsections (c)
5656 and (d); and
5757 (2) use available resources to fund the pilot program.
5858 (g) A report required by this section may be submitted
5959 electronically.
6060 (h) This section expires September 1, 2013.
6161 SECTION 2. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2011.
