|---|
| 12 | 12 | | certain state agencies. |

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 14 | 14 | | SECTION 1. Subchapter D, Chapter 301, Labor Code, is |
|---|
| 15 | 15 | | amended by adding Section 301.068 to read as follows: |
|---|
| 16 | 16 | | Sec. 301.068. EFFICIENCY PILOT PROGRAM. (a) The |
|---|
| 17 | 17 | | commission shall establish a pilot program to: |
|---|
| 18 | 18 | | (1) improve the efficiency and quality of commission |
|---|
| 19 | 19 | | operations while reducing costs; and |
|---|
| 20 | 20 | | (2) adopt a structured approach for identifying the |
|---|
| 21 | 21 | | wasteful use of state resources and improving commission processes. |
|---|
| 22 | 22 | | (b) In implementing the pilot program, the commission shall |
|---|
| 23 | 23 | | use: |
|---|
| 24 | 24 | | (1) a methodology that includes a define, measure, |
|---|
| 25 | 25 | | analyze, improve, and control structure for reviewing project |
|---|
| 26 | 26 | | management; |
|---|
| 27 | 27 | | (2) a continuous improvement technique that: |
|---|
| 28 | 28 | | (A) identifies value and a value stream; |
|---|
| 29 | 29 | | (B) creates a flow for activities; |
|---|
| 30 | 30 | | (C) allows consumers to pull products or services |
|---|
| 31 | 31 | | through the process; and |
|---|
| 32 | 32 | | (D) allows for the process to be perfected over |
|---|
| 33 | 33 | | time; and |
|---|
| 34 | 34 | | (3) a measurement system analysis to evaluate data. |
|---|
| 35 | 35 | | (c) The commission shall conduct an internal performance |
|---|
| 36 | 36 | | audit to assess the effectiveness of the pilot program implemented |
|---|
| 37 | 37 | | under this section. |
|---|
| 38 | 38 | | (d) Not later than August 1, 2012, the commission shall |
|---|
| 39 | 39 | | submit a written report of the results of the performance audit to |
|---|
| 40 | 40 | | the: |
|---|
| 41 | 41 | | (1) governor; |
|---|
| 42 | 42 | | (2) lieutenant governor; |
|---|
| 43 | 43 | | (3) speaker of the house of representatives; |
|---|
| 44 | 44 | | (4) Senate Committee on Government Organization; |
|---|
| 45 | 45 | | (5) House Government Efficiency and Reform Committee; |
|---|
| 46 | 46 | | and |
|---|
| 47 | 47 | | (6) house and senate committees with primary |
|---|
| 48 | 48 | | jurisdiction over state affairs. |
|---|
| 49 | 49 | | (e) The commission shall implement the pilot program from |
|---|
| 50 | 50 | | available funds that may be used for that purpose. |
|---|
| 51 | 51 | | (f) A state agency, other than the commission, may implement |
|---|
| 52 | 52 | | the pilot program established under this section with respect to |
|---|
| 53 | 53 | | the agency. An agency that implements the pilot program shall: |
|---|
| 54 | 54 | | (1) conduct the performance audit and submit the |
|---|
| 55 | 55 | | written report in the time and manner described by Subsections (c) |
|---|
| 56 | 56 | | and (d); and |
|---|
| 57 | 57 | | (2) use available resources to fund the pilot program. |
|---|
| 58 | 58 | | (g) A report required by this section may be submitted |
|---|
| 59 | 59 | | electronically. |
|---|
| 60 | 60 | | (h) This section expires September 1, 2013. |
|---|
| 61 | 61 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 62 | 62 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 63 | 63 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 64 | 64 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 65 | 65 | | Act takes effect September 1, 2011. |
