| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 301.085, Labor Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 301.085. UNEMPLOYMENT COMPENSATION AND JOB MATCHING |
|---|
| 13 | 13 | | SERVICES INFORMATION; OFFENSE; PENALTY. |
|---|
| 14 | 14 | | SECTION 2. Section 301.085, Labor Code, is amended by |
|---|
| 15 | 15 | | amending Subsections (a), (c), and (d) and adding Subsection (b-1) |
|---|
| 16 | 16 | | to read as follows: |
|---|
| 17 | 17 | | (a) In this section: |
|---|
| 18 | 18 | | (1) "Job matching services information" means |
|---|
| 19 | 19 | | information in the records of the commission that pertains to the |
|---|
| 20 | 20 | | commission's job matching services provided to employers and job |
|---|
| 21 | 21 | | seekers through the Internet, workforce centers, or other means. |
|---|
| 22 | 22 | | (2) "Unemployment [, "unemployment] compensation |
|---|
| 23 | 23 | | information" means information in the records of the commission |
|---|
| 24 | 24 | | that pertains to the administration of Subtitle A, including any |
|---|
| 25 | 25 | | information collected, received, developed, or maintained in the |
|---|
| 26 | 26 | | administration of unemployment compensation benefits or the |
|---|
| 27 | 27 | | unemployment compensation tax system. |
|---|
| 28 | 28 | | (b-1) The commission shall adopt and enforce reasonable |
|---|
| 29 | 29 | | rules governing the confidentiality, custody, use, preservation, |
|---|
| 30 | 30 | | and disclosure of job matching services information. The rules |
|---|
| 31 | 31 | | must include safeguards to protect the confidentiality of |
|---|
| 32 | 32 | | identifying information regarding any individual or any past or |
|---|
| 33 | 33 | | present employer or employing unit contained in job matching |
|---|
| 34 | 34 | | services information, including any information that foreseeably |
|---|
| 35 | 35 | | could be combined with other publicly available information to |
|---|
| 36 | 36 | | reveal identifying information regarding the individual, employer, |
|---|
| 37 | 37 | | or employing unit, as applicable. |
|---|
| 38 | 38 | | (c) Unemployment compensation information and job matching |
|---|
| 39 | 39 | | services information are [is] not public information for purposes |
|---|
| 40 | 40 | | of Chapter 552, Government Code. |
|---|
| 41 | 41 | | (d) Unless permitted by this subchapter or commission rule, |
|---|
| 42 | 42 | | a person commits an offense if the person solicits, discloses, |
|---|
| 43 | 43 | | receives, or uses, or authorizes, permits, participates in, or |
|---|
| 44 | 44 | | acquiesces in another person's use of, unemployment compensation |
|---|
| 45 | 45 | | information or job matching services information that reveals: |
|---|
| 46 | 46 | | (1) identifying information regarding any individual |
|---|
| 47 | 47 | | or past or present employer or employing unit; or |
|---|
| 48 | 48 | | (2) information that foreseeably could be combined |
|---|
| 49 | 49 | | with other publicly available information to reveal identifying |
|---|
| 50 | 50 | | information regarding any individual or past or present employer or |
|---|
| 51 | 51 | | employing unit. |
|---|
| 52 | 52 | | SECTION 3. This Act takes effect September 1, 2011. |
