99 relating to incentives for the purchase or lease of an
1010 electric-powered light-duty motor vehicle.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 386.152(b), Health and Safety Code, is
1313 amended to read as follows:
1414 (b) The program shall authorize statewide incentives for
1515 the purchase or lease, according to the schedule provided by
1616 Section 386.153, of new gasoline-powered light-duty motor vehicles
1717 that are certified by the United States Environmental Protection
1818 Agency to meet an emissions standard that is at least as stringent
1919 as those provided by Section 386.153(a) and new light-duty motor
2020 vehicles powered wholly or partly by an electric motor under
2121 Section 386.153(b) [386.153] for a purchaser or lessee who agrees
2222 to register the vehicle in this state and to operate the vehicle in
2323 this state for not less than 75 percent of the vehicle's annual
2424 mileage.
2525 SECTION 2. Section 386.153, Health and Safety Code, is
2626 amended to read as follows:
2727 Sec. 386.153. LIGHT-DUTY MOTOR VEHICLE PURCHASE OR LEASE
2828 INCENTIVE SCHEDULE. (a) A new light-duty motor vehicle powered
2929 exclusively by a gasoline engine is eligible for an incentive
3030 according to the following schedule:
3131 Incentive emissions standard and incentive amount
3232 Model year 2003-2007
3333 Bin 4 $1,250
3434 Bin 3 $2,225
3535 Bin 2 $3,750
3636 Bin 1 $5,000
3737 (b) A new light-duty motor vehicle powered wholly or partly
3838 by an electric motor, including a vehicle that draws power from a
3939 battery or a hybrid engine, is eligible for a $2,500 incentive. A
4040 recreational vehicle, as defined by Section 522.004(b),
4141 Transportation Code, that draws power from a battery or a hybrid
4242 engine solely for purposes other than propulsion is not eligible
4343 for an incentive under this subsection.
4444 (c) The incentive under Subsection (b) is limited to 2,000
4545 vehicles for the state fiscal biennium beginning September 1, 2011.
4646 This subsection expires September 1, 2013.
4747 SECTION 3. Section 386.154, Health and Safety Code, is
4848 amended to read as follows:
4949 Sec. 386.154. MODIFICATION OF INCENTIVE EMISSIONS
5050 STANDARDS. After evaluating new technologies and after public
5151 notice and comment, the commission, in consultation with the
5252 advisory board, may change the incentive emissions standards
5353 established by Section 386.153(a) [386.153] to improve the ability
5454 of the program to achieve its goals.
5555 SECTION 4. Section 386.155, Health and Safety Code, is
5656 amended to read as follows:
5757 Sec. 386.155. MANUFACTURER'S REPORT. At the beginning of
5858 but not later than July 1 of each year preceding the vehicle model
5959 year, a manufacturer of motor vehicles shall provide to the
6060 commission a list of the new vehicle models that the manufacturer
6161 intends to sell in this state during that model year that meet the
6262 incentive emissions standards established by the schedules set out
6363 under Section 386.153(a) or that are motor vehicles powered wholly
6464 or partly by an electric motor as described by Section 386.153(b)
6565 [386.153]. The manufacturer may supplement the list provided to
6666 the commission under this section as necessary to include
6767 additional new vehicle models the manufacturer intends to sell in
6868 this state during the model year.
6969 SECTION 5. This Act takes effect September 1, 2011.
