 A BILL TO BE ENTITLED
 AN ACT
 relating to gifts and donations to the McLennan County Juvenile
 Board.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter D, Chapter 152, Human Resources Code,
 is amended by adding Sections 152.1613 and 152.1614 to read as
 follows:
 Sec. 152.1613.  MCLENNAN COUNTY JUVENILE BOARD LOCAL
 ENRICHMENT PROGRAM. The McLennan County Juvenile Board may
 establish and administer a local enrichment of juvenile services
 program consistent with policies adopted by the juvenile board.
 Sec. 152.1614.  GIFT, GRANT, OR DONATION TO MCLENNAN COUNTY
 JUVENILE BOARD. (a) The McLennan County Juvenile Board may accept a
 gift, grant, or donation from a public or private source for any
 lawful purpose, including support of a local enrichment of juvenile
 services program.
 (b)  The juvenile board shall place a donation of money under
 Subsection (a) in a special fund that is:
 (1)  subject to all reporting or procedural
 requirements of the county auditor; and
 (2)  audited annually by the county auditor.
 (c)  Notwithstanding Subsection (b), the juvenile board is
 not required to establish or adopt a budget for expenditures under
 the special fund described by this section.
 (d)  The special fund described by Subsection (b) may be used
 only to pay expenses of and related to programs, services, and items
 approved by the juvenile board.
 (e)  An expenditure from the special fund described by
 Subsection (b) must comply with the requirements of Chapter 262,
 Local Government Code, that apply to the juvenile board's other
 expenditures.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
