1010 AN ACT
1111 relating to gifts and donations to the McLennan County Juvenile
1212 Board.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter D, Chapter 152, Human Resources Code,
1515 is amended by adding Sections 152.1613 and 152.1614 to read as
1616 follows:
1717 Sec. 152.1613. MCLENNAN COUNTY JUVENILE BOARD LOCAL
1818 ENRICHMENT PROGRAM. The McLennan County Juvenile Board may
1919 establish and administer a local enrichment of juvenile services
2020 program consistent with policies adopted by the juvenile board.
2121 Sec. 152.1614. GIFT, GRANT, OR DONATION TO MCLENNAN COUNTY
2222 JUVENILE BOARD. (a) The McLennan County Juvenile Board may accept a
2323 gift, grant, or donation from a public or private source for any
2424 lawful purpose, including support of a local enrichment of juvenile
2525 services program.
2626 (b) The juvenile board shall place a donation of money under
2727 Subsection (a) in a special fund that is:
2828 (1) subject to all reporting or procedural
2929 requirements of the county auditor; and
3030 (2) audited annually by the county auditor.
3131 (c) Notwithstanding Subsection (b), the juvenile board is
3232 not required to establish or adopt a budget for expenditures under
3333 the special fund described by this section.
3434 (d) The special fund described by Subsection (b) may be used
3535 only to pay expenses of and related to programs, services, and items
3636 approved by the juvenile board.
3737 (e) An expenditure from the special fund described by
3838 Subsection (b) must comply with the requirements of Chapter 262,
3939 Local Government Code, that apply to the juvenile board's other
4040 expenditures.
4141 SECTION 2. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2011.
