| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Subchapter D, Chapter 152, Human Resources Code, |
|---|
| 15 | 15 | | is amended by adding Sections 152.1613 and 152.1614 to read as |
|---|
| 16 | 16 | | follows: |
|---|
| 17 | 17 | | Sec. 152.1613. MCLENNAN COUNTY JUVENILE BOARD LOCAL |
|---|
| 18 | 18 | | ENRICHMENT PROGRAM. The McLennan County Juvenile Board may |
|---|
| 19 | 19 | | establish and administer a local enrichment of juvenile services |
|---|
| 20 | 20 | | program consistent with policies adopted by the juvenile board. |
|---|
| 21 | 21 | | Sec. 152.1614. GIFT, GRANT, OR DONATION TO MCLENNAN COUNTY |
|---|
| 22 | 22 | | JUVENILE BOARD. (a) The McLennan County Juvenile Board may accept a |
|---|
| 23 | 23 | | gift, grant, or donation from a public or private source for any |
|---|
| 24 | 24 | | lawful purpose, including support of a local enrichment of juvenile |
|---|
| 25 | 25 | | services program. |
|---|
| 26 | 26 | | (b) The juvenile board shall place a donation of money under |
|---|
| 27 | 27 | | Subsection (a) in a special fund that is: |
|---|
| 28 | 28 | | (1) subject to all reporting or procedural |
|---|
| 29 | 29 | | requirements of the county auditor; and |
|---|
| 30 | 30 | | (2) audited annually by the county auditor. |
|---|
| 31 | 31 | | (c) Notwithstanding Subsection (b), the juvenile board is |
|---|
| 32 | 32 | | not required to establish or adopt a budget for expenditures under |
|---|
| 33 | 33 | | the special fund described by this section. |
|---|
| 34 | 34 | | (d) The special fund described by Subsection (b) may be used |
|---|
| 35 | 35 | | only to pay expenses of and related to programs, services, and items |
|---|
| 36 | 36 | | approved by the juvenile board. |
|---|
| 37 | 37 | | (e) An expenditure from the special fund described by |
|---|
| 38 | 38 | | Subsection (b) must comply with the requirements of Chapter 262, |
|---|
| 39 | 39 | | Local Government Code, that apply to the juvenile board's other |
|---|
| 40 | 40 | | expenditures. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2011. |
