99 AN ACT
1010 relating to the extension of the deadline for holding the
1111 confirmation and initial directors' election of the Tradition
1212 Municipal Utility District No. 2 of Denton County.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 8189.003, Special District Local Laws
1515 Code, is amended to read as follows:
1616 Sec. 8189.003. CONFIRMATION ELECTION REQUIRED. If the
1717 creation of the district is not confirmed at a confirmation
1818 election held under Section 8189.024 before September 1, 2015
1919 [2011]:
2020 (1) the district is dissolved September 1, 2015
2121 [2011], except that:
2222 (A) any debts incurred shall be paid;
2323 (B) any assets that remain after the payment of
2424 debts shall be transferred to Denton County; and
2525 (C) the organization of the district shall be
2626 maintained until all debts are paid and remaining assets are
2727 transferred; and
2828 (2) this chapter expires September 1, 2018 [2014].
2929 SECTION 2. Section 8189.021, Special District Local Laws
3030 Code, is amended by amending Subsection (d) and adding Subsections
3131 (e) and (f) to read as follows:
3232 (d) Temporary directors serve until the earlier of:
3333 (1) the date initial directors are elected under
3434 Section 8189.024; or
3535 (2) the fourth anniversary of the date on which the
3636 temporary directors were appointed [date this subchapter expires
3737 under Section 8189.026].
3838 (e) If initial directors have not been elected under Section
3939 8189.024 and the terms of the temporary directors have expired,
4040 successor temporary directors shall be appointed or reappointed as
4141 provided by Subsection (f) to serve terms that expire on the
4242 earliest of:
4343 (1) the date initial directors are elected under
4444 Section 8189.024;
4545 (2) the fourth anniversary of the date of the
4646 appointment or reappointment; or
4747 (3) the date this chapter expires under Section
4848 8189.003.
4949 (f) If Subsection (e) applies, the owner or owners of a
5050 majority of the assessed value of the real property in the district
5151 may submit a petition to the Texas Commission on Environmental
5252 Quality requesting that the commission appoint as successor
5353 temporary directors the five persons named in the petition. The
5454 commission shall appoint as successor temporary directors the five
5555 persons named in the petition.
5656 SECTION 3. Section 8189.026, Special District Local Laws
5757 Code, is amended to read as follows:
5858 Sec. 8189.026. EXPIRATION OF SUBCHAPTER. This subchapter
5959 expires September 1, 2018 [2014].
6060 SECTION 4. (a) The legal notice of the intention to
6161 introduce this Act, setting forth the general substance of this
6262 Act, has been published as provided by law, and the notice and a
6363 copy of this Act have been furnished to all persons, agencies,
6464 officials, or entities to which they are required to be furnished
6565 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
6666 Government Code.
6767 (b) The governor, one of the required recipients, has
6868 submitted the notice and Act to the Texas Commission on
6969 Environmental Quality.
7070 (c) The Texas Commission on Environmental Quality has filed
7171 its recommendations relating to this Act with the governor, the
7272 lieutenant governor, and the speaker of the house of
7373 representatives within the required time.
7474 (d) All requirements of the constitution and laws of this
7575 state and the rules and procedures of the legislature with respect
7676 to the notice, introduction, and passage of this Act are fulfilled
7777 and accomplished.
7878 SECTION 5. This Act takes effect immediately if it receives
7979 a vote of two-thirds of all the members elected to each house, as
8080 provided by Section 39, Article III, Texas Constitution. If this
8181 Act does not receive the vote necessary for immediate effect, this
8282 Act takes effect September 1, 2011.
