7	7	relating to compensation for services and reimbursement for
8	8	expenses of a member of the board of directors of the Lake View
9	9	Management and Development District.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 3828.056, Special District Local Laws
12	12	Code, is amended to read as follows:
13	13	Sec. 3828.056. COMPENSATION. (a) In this section,
14	14	"performing the duties of a director" means substantive performance
15	15	of the management or business of the district, including
16	16	participation in board and committee meetings and other activities
17	17	involving the substantive deliberation of district business and in
18	18	pertinent educational programs. The term does not include routine
19	19	or ministerial activities such as the execution of documents,
20	20	self-preparation for meetings, or other activities requiring a
21	21	minimal amount of time.
22	22	(b) A director is [not] entitled to receive fees of office
23	23	of not more than $150 a day for each day the director spends
24	24	performing the duties of a director as compensation for service on
25	25	the board and [but] is entitled to reimbursement for necessary and
26	26	reasonable expenses incurred in performing [carrying out] the
27	27	duties [and responsibilities] of a director.
28	28	(c) The board by resolution shall set a limit on the fees of
29	29	office that a director may receive in a year. The board may not set
30	30	the limit at more than $7,200.
31	31	(d) To receive compensation or reimbursement for expenses,
32	32	a director must file with the district a verified statement showing
33	33	the number of days spent performing the duties of a director and a
34	34	general description of the duties performed for each day of
35	35	service.
36	36	SECTION 2. The changes in law made by this Act apply only to
37	37	the compensation and reimbursement for expenses of a member of the
38	38	board of directors of the Lake View Management and Development
39	39	District for the performance of duties on or after the effective
40	40	date of this Act. The compensation or reimbursement for expenses
41	41	before the effective date of this Act is governed by the law in
42	42	effect when the duty is performed, and the former law is continued
43	43	in effect for that purpose.
44	44	SECTION 3. (a) The legal notice of the intention to
45	45	introduce this Act, setting forth the general substance of this
46	46	Act, has been published as provided by law, and the notice and a
47	47	copy of this Act have been furnished to all persons, agencies,
48	48	officials, or entities to which they are required to be furnished
49	49	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
50	50	Government Code.
51	51	(b) The governor, one of the required recipients, has
52	52	submitted the notice and Act to the Texas Commission on
53	53	Environmental Quality.
54	54	(c) The Texas Commission on Environmental Quality has filed
55	55	its recommendations relating to this Act with the governor,
56	56	lieutenant governor, and speaker of the house of representatives
57	57	within the required time.
58	58	(d) All requirements of the constitution and laws of this
59	59	state and the rules and procedures of the legislature with respect
60	60	to the notice, introduction, and passage of this Act have been
61	61	fulfilled and accomplished.
62	62	SECTION 4. This Act takes effect immediately if it receives
63	63	a vote of two-thirds of all the members elected to each house, as
64	64	provided by Section 39, Article III, Texas Constitution. If this
65	65	Act does not receive the vote necessary for immediate effect, this
66	66	Act takes effect September 1, 2011.
