1010 AN ACT
1111 relating to the powers of rural and urban transit districts.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 458.011, Transportation Code, is amended
1414 to read as follows:
1515 Sec. 458.011. ADDITIONAL POWERS OF RURAL OR URBAN TRANSIT
1616 DISTRICT. (a) A rural or urban transit district may contract with
1717 any governmental agency or private person, firm, or corporation
1818 for:
1919 (1) the use by either party to the contract of all or
2020 any part of a facility, structure, interest in land, air right over
2121 land, or right-of-way that is owned, leased, or held by the other
2222 party; or
2323 (2) the purpose of planning, constructing, or
2424 operating a facility or performing a service that the rural transit
2525 district is authorized to operate or perform.
2626 (b) The governing body of a rural or urban transit district
2727 by resolution may adopt rules for the safe and efficient operation
2828 and maintenance of the transit district's transportation system,
2929 except that the rules may not relate to Subchapter H, Chapter 411,
3030 Government Code.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2011.
