| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 458.011, Transportation Code, is amended |
|---|
| 14 | 14 | | to read as follows: |
|---|
| 15 | 15 | | Sec. 458.011. ADDITIONAL POWERS OF RURAL OR URBAN TRANSIT |
|---|
| 16 | 16 | | DISTRICT. (a) A rural or urban transit district may contract with |
|---|
| 17 | 17 | | any governmental agency or private person, firm, or corporation |
|---|
| 18 | 18 | | for: |
|---|
| 19 | 19 | | (1) the use by either party to the contract of all or |
|---|
| 20 | 20 | | any part of a facility, structure, interest in land, air right over |
|---|
| 21 | 21 | | land, or right-of-way that is owned, leased, or held by the other |
|---|
| 22 | 22 | | party; or |
|---|
| 23 | 23 | | (2) the purpose of planning, constructing, or |
|---|
| 24 | 24 | | operating a facility or performing a service that the rural transit |
|---|
| 25 | 25 | | district is authorized to operate or perform. |
|---|
| 26 | 26 | | (b) The governing body of a rural or urban transit district |
|---|
| 27 | 27 | | by resolution may adopt rules for the safe and efficient operation |
|---|
| 28 | 28 | | and maintenance of the transit district's transportation system, |
|---|
| 29 | 29 | | except that the rules may not relate to Subchapter H, Chapter 411, |
|---|
| 30 | 30 | | Government Code. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2011. |
