| 11 | 11 | | relating to the fees for certain commercial vehicles. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 502.167(c), Transportation Code, as |
|---|
| 14 | 14 | | effective September 1, 2011, is amended to read as follows: |
|---|
| 15 | 15 | | (c) The fee [for a registration year] for registration of a |
|---|
| 16 | 16 | | semitrailer used in the manner described by Subsection (a), |
|---|
| 17 | 17 | | regardless of the date the semitrailer is registered, is[: |
|---|
| 18 | 18 | | [(1) $30, for a semitrailer being propelled by a power |
|---|
| 19 | 19 | | unit for which a permit under Section 623.011 has been issued; or |
|---|
| 20 | 20 | | [(2)] $15 for a registration year [, for a semitrailer |
|---|
| 21 | 21 | | being propelled by a power unit for which a permit under Section |
|---|
| 22 | 22 | | 623.011 has not been issued]. |

| 23 | 23 | | SECTION 2. Section 623.011(b), Transportation Code, is |
|---|
| 24 | 24 | | amended to read as follows: |
|---|
| 25 | 25 | | (b) To qualify for a permit under this section: |
|---|
| 26 | 26 | | (1) the vehicle must be registered under Chapter 502 |
|---|
| 27 | 27 | | for the maximum gross weight applicable to the vehicle under |
|---|
| 28 | 28 | | Section 621.101, not to exceed 80,000 pounds; |
|---|
| 29 | 29 | | (2) the security requirement of Section 623.012 must |
|---|
| 30 | 30 | | be satisfied; and |
|---|
| 31 | 31 | | (3) a base permit fee of $90 [$75], any additional fee |
|---|
| 32 | 32 | | required by Section 623.0111, and any additional fee set by the |
|---|
| 33 | 33 | | department under Section 623.0112 must be paid. |

| 34 | 34 | | SECTION 3. Section 621.353(a), Transportation Code, is |
|---|
| 35 | 35 | | amended to read as follows: |
|---|
| 36 | 36 | | (a) The comptroller shall send $50 of each base fee |
|---|
| 37 | 37 | | collected under Section 623.011 for an excess weight permit to the |
|---|
| 38 | 38 | | counties of the state, with each county receiving an amount |
|---|
| 39 | 39 | | determined according to the ratio of the total number of miles of |
|---|
| 40 | 40 | | county roads maintained by the county to the total number of miles |
|---|
| 41 | 41 | | of county roads maintained by all of the counties of this state. |
|---|
| 42 | 42 | | The comptroller shall deposit $40 [$25] of each base fee, plus each |
|---|
| 43 | 43 | | fee collected under Section 623.0112, to the credit of the state |
|---|
| 44 | 44 | | highway fund. Money deposited to the credit of that fund under this |
|---|
| 45 | 45 | | subsection may be appropriated only to the department to administer |
|---|
| 46 | 46 | | this section and Sections 623.011, 623.0111, and 623.0112. |
|---|
| 47 | 47 | | SECTION 4. (a) The changes in law made by this Act apply |
|---|
| 48 | 48 | | only to fees charged for a vehicle registration or permit issued on |
|---|
| 49 | 49 | | or after the effective date of this Act. |
|---|
| 50 | 50 | | (b) A vehicle registration or permit issued before the |
|---|
| 51 | 51 | | effective date of this Act is covered by the law in effect when the |
|---|
| 52 | 52 | | registration or permit was issued, and the former law is continued |
|---|
| 53 | 53 | | in effect for that purpose. |
|---|
| 54 | 54 | | SECTION 5. This Act takes effect September 1, 2011. |
