11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter C, Chapter 101, Labor Code, is | |
13 | 13 | amended by adding Section 101.1035 to read as follows: | |
14 | 14 | Sec. 101.1035. EXCLUSIVE BARGAINING REPRESENTATIVE; METHOD | |
15 | 15 | OF ELECTION. (a) In this section, "exclusive bargaining | |
16 | 16 | representative" means a labor union selected as the representative | |
17 | 17 | of the employees in an appropriate collective bargaining unit to | |
18 | 18 | represent the employees in their employment relations with | |
19 | 19 | employers. | |
20 | 20 | (b) An exclusive bargaining representative must be elected | |
21 | 21 | by secret ballot and by majority vote of the employees present and | |
22 | 22 | participating. | |
23 | 23 | SECTION 2. This Act does not affect a collective bargaining | |
24 | 24 | agreement under Chapter 174, Local Government Code, that was | |
25 | 25 | entered into before the effective date of this Act. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2011. |
