99 relating to notice for certain transactions involving local
1010 government entities in populous counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 44, Education Code, is
1313 amended by adding Section 44.0316 to read as follows:
1414 Sec. 44.0316. NOTICE PUBLICATION IN POPULOUS COUNTIES. (a)
1515 If a school district located wholly or partly in a county with a
1616 population of one million or more maintains an Internet website,
1717 the district, instead of meeting the publication requirements under
1818 Section 44.031(g), may:
1919 (1) publish notice in a newspaper described by Section
2020 44.031(g) once not later than the 14th day before the bid receipt
2121 deadline; and
2222 (2) post notice continuously on the district website,
2323 with a conspicuous link to the notice on the site's home page, for
2424 at least 14 days immediately preceding the bid receipt deadline.
2525 (b) The newspaper notice under Subsection (a) must include
2626 the time and place at which the bids will be publicly opened and the
2727 Internet website address for the procurement information.
2828 (c) The board of trustees of a school district shall
2929 publicly adopt standards to ensure that Internet posting of notice
3030 under this section is archived.
3131 SECTION 2. Subchapter C, Chapter 252, Local Government
3232 Code, is amended by adding Section 252.0411 to read as follows:
3333 Sec. 252.0411. NOTICE PUBLICATION IN POPULOUS COUNTIES.
3434 (a) If a municipality located wholly or partly in a county with a
3535 population of one million or more maintains an Internet website,
3636 the municipality, instead of meeting the publication requirements
3737 under Section 252.041(a), may:
3838 (1) publish notice in a newspaper described by Section
3939 252.041(a) once not later than the 14th day before the bid receipt
4040 deadline; and
4141 (2) post notice continuously on the municipal website,
4242 with a conspicuous link to the notice on the site's home page, for
4343 at least 14 days immediately preceding the bid receipt deadline.
4444 (b) The newspaper notice under Subsection (a) must include
4545 the time and place at which the bids will be publicly opened and the
4646 Internet website address for the procurement information.
4747 (c) The governing body of a municipality shall publicly
4848 adopt standards to ensure that Internet posting of notice under
4949 this section is archived.
5050 SECTION 3. Subchapter C, Chapter 262, Local Government
5151 Code, is amended by adding Section 262.0251 to read as follows:
5252 Sec. 262.0251. NOTICE PUBLICATION IN POPULOUS COUNTIES. (a)
5353 If a county with a population of one million or more maintains an
5454 Internet website, the county, instead of meeting the publication
5555 requirements under Section 262.025(a), may:
5656 (1) publish notice in a newspaper described by Section
5757 262.025(a) once not later than the 14th day before the bid receipt
5858 deadline; and
5959 (2) post notice continuously on the county website,
6060 with a conspicuous link to the notice on the site's home page, for
6161 at least 14 days immediately preceding the bid receipt deadline.
6262 (b) The newspaper notice under Subsection (a) must include
6363 the time and place at which the bids will be publicly opened and the
6464 Internet website address for the procurement information.
6565 (c) The commissioners court shall publicly adopt standards
6666 to ensure that Internet posting of notice under this section is
6767 archived.
6868 SECTION 4. Subchapter B, Chapter 271, Local Government
6969 Code, is amended by adding Section 271.0251 to read as follows:
7070 Sec. 271.0251. NOTICE PUBLICATION IN POPULOUS COUNTIES. (a)
7171 If a governmental entity located wholly or partly in a county with a
7272 population of one million or more maintains an Internet website,
7373 the entity, instead of meeting the publication requirements under
7474 Section 271.025(b), may:
7575 (1) publish notice in a newspaper described by Section
7676 271.025(b) once not later than the 14th day before the bid receipt
7777 deadline; and
7878 (2) post notice continuously on the entity's website,
7979 with a conspicuous link to the notice on the site's home page, for
8080 at least 14 days immediately preceding the bid receipt deadline.
8181 (b) The newspaper notice under Subsection (a) must include
8282 the time and place at which the bids will be publicly opened and the
8383 Internet website address for the procurement information.
8484 (c) The governing body of the governmental entity shall
8585 publicly adopt standards to ensure that Internet posting of notice
8686 under this section is archived.
8787 SECTION 5. The changes in law made by this Act apply only to
8888 a notice required to be provided on or after September 1, 2011. A
8989 notice required to be provided before September 1, 2011, is
9090 governed by the law in effect immediately before that date, and that
9191 law is continued in effect for that purpose.
9292 SECTION 6. This Act takes effect September 1, 2011.
