8	8	AN ACT
9	9	relating to notice for certain transactions involving local
10	10	government entities in populous counties.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Subchapter B, Chapter 44, Education Code, is
13	13	amended by adding Section 44.0316 to read as follows:
14	14	Sec. 44.0316. NOTICE PUBLICATION IN POPULOUS COUNTIES. (a)
15	15	If a school district located wholly or partly in a county with a
16	16	population of one million or more maintains an Internet website,
17	17	the district, instead of meeting the publication requirements under
18	18	Section 44.031(g), may:
19	19	(1) publish notice in a newspaper described by Section
20	20	44.031(g) once not later than the 14th day before the bid receipt
21	21	deadline; and
22	22	(2) post notice continuously on the district website,
23	23	with a conspicuous link to the notice on the site's home page, for
24	24	at least 14 days immediately preceding the bid receipt deadline.
25	25	(b) The newspaper notice under Subsection (a) must include
26	26	the time and place at which the bids will be publicly opened and the
27	27	Internet website address for the procurement information.
28	28	(c) The board of trustees of a school district shall
29	29	publicly adopt standards to ensure that Internet posting of notice
30	30	under this section is archived.
31	31	SECTION 2. Subchapter C, Chapter 252, Local Government
32	32	Code, is amended by adding Section 252.0411 to read as follows:
33	33	Sec. 252.0411. NOTICE PUBLICATION IN POPULOUS COUNTIES.
34	34	(a) If a municipality located wholly or partly in a county with a
35	35	population of one million or more maintains an Internet website,
36	36	the municipality, instead of meeting the publication requirements
37	37	under Section 252.041(a), may:
38	38	(1) publish notice in a newspaper described by Section
39	39	252.041(a) once not later than the 14th day before the bid receipt
40	40	deadline; and
41	41	(2) post notice continuously on the municipal website,
42	42	with a conspicuous link to the notice on the site's home page, for
43	43	at least 14 days immediately preceding the bid receipt deadline.
44	44	(b) The newspaper notice under Subsection (a) must include
45	45	the time and place at which the bids will be publicly opened and the
46	46	Internet website address for the procurement information.
47	47	(c) The governing body of a municipality shall publicly
48	48	adopt standards to ensure that Internet posting of notice under
49	49	this section is archived.
50	50	SECTION 3. Subchapter C, Chapter 262, Local Government
51	51	Code, is amended by adding Section 262.0251 to read as follows:
52	52	Sec. 262.0251. NOTICE PUBLICATION IN POPULOUS COUNTIES. (a)
53	53	If a county with a population of one million or more maintains an
54	54	Internet website, the county, instead of meeting the publication
55	55	requirements under Section 262.025(a), may:
56	56	(1) publish notice in a newspaper described by Section
57	57	262.025(a) once not later than the 14th day before the bid receipt
58	58	deadline; and
59	59	(2) post notice continuously on the county website,
60	60	with a conspicuous link to the notice on the site's home page, for
61	61	at least 14 days immediately preceding the bid receipt deadline.
62	62	(b) The newspaper notice under Subsection (a) must include
63	63	the time and place at which the bids will be publicly opened and the
64	64	Internet website address for the procurement information.
65	65	(c) The commissioners court shall publicly adopt standards
66	66	to ensure that Internet posting of notice under this section is
67	67	archived.
68	68	SECTION 4. Subchapter B, Chapter 271, Local Government
69	69	Code, is amended by adding Section 271.0251 to read as follows:
70	70	Sec. 271.0251. NOTICE PUBLICATION IN POPULOUS COUNTIES. (a)
71	71	If a governmental entity located wholly or partly in a county with a
72	72	population of one million or more maintains an Internet website,
73	73	the entity, instead of meeting the publication requirements under
74	74	Section 271.025(b), may:
75	75	(1) publish notice in a newspaper described by Section
76	76	271.025(b) once not later than the 14th day before the bid receipt
77	77	deadline; and
78	78	(2) post notice continuously on the entity's website,
79	79	with a conspicuous link to the notice on the site's home page, for
80	80	at least 14 days immediately preceding the bid receipt deadline.
81	81	(b) The newspaper notice under Subsection (a) must include
82	82	the time and place at which the bids will be publicly opened and the
83	83	Internet website address for the procurement information.
84	84	(c) The governing body of the governmental entity shall
85	85	publicly adopt standards to ensure that Internet posting of notice
86	86	under this section is archived.
87	87	SECTION 5. The changes in law made by this Act apply only to
88	88	a notice required to be provided on or after September 1, 2011. A
89	89	notice required to be provided before September 1, 2011, is
90	90	governed by the law in effect immediately before that date, and that
91	91	law is continued in effect for that purpose.
92	92	SECTION 6. This Act takes effect September 1, 2011.
