 A BILL TO BE ENTITLED
 AN ACT
 relating to notice for certain transactions involving local
 government entities in populous counties.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter B, Chapter 44, Education Code, is
 amended by adding Section 44.0316 to read as follows:
 Sec. 44.0316.  NOTICE PUBLICATION IN POPULOUS COUNTIES.  (a)
 If a school district located wholly or partly in a county with a
 population of one million or more maintains an Internet website,
 the district, instead of meeting the publication requirements under
 Section 44.031(g), may:
 (1)  publish notice in a newspaper described by Section
 44.031(g) once not later than the 14th day before the bid receipt
 deadline; and
 (2)  post notice continuously on the district website,
 with a conspicuous link to the notice on the site's home page, for
 at least 14 days immediately preceding the bid receipt deadline.
 (b)  The newspaper notice under Subsection (a) must include
 the time and place at which the bids will be publicly opened and the
 Internet website address for the procurement information.
 (c)  The board of trustees of a school district shall
 publicly adopt standards to ensure that Internet posting of notice
 under this section is archived.
 SECTION 2.  Subchapter C, Chapter 252, Local Government
 Code, is amended by adding Section 252.0411 to read as follows:
 Sec. 252.0411.  NOTICE PUBLICATION IN POPULOUS COUNTIES.
 (a)  If a municipality located wholly or partly in a county with a
 population of one million or more maintains an Internet website,
 the municipality, instead of meeting the publication requirements
 under Section 252.041(a), may:
 (1)  publish notice in a newspaper described by Section
 252.041(a) once not later than the 14th day before the bid receipt
 deadline; and
 (2)  post notice continuously on the municipal website,
 with a conspicuous link to the notice on the site's home page, for
 at least 14 days immediately preceding the bid receipt deadline.
 (b)  The newspaper notice under Subsection (a) must include
 the time and place at which the bids will be publicly opened and the
 Internet website address for the procurement information.
 (c)  The governing body of a municipality shall publicly
 adopt standards to ensure that Internet posting of notice under
 this section is archived.
 SECTION 3.  Subchapter C, Chapter 262, Local Government
 Code, is amended by adding Section 262.0251 to read as follows:
 Sec. 262.0251.  NOTICE PUBLICATION IN POPULOUS COUNTIES.  (a)
 If a county with a population of one million or more maintains an
 Internet website, the county, instead of meeting the publication
 requirements under Section 262.025(a), may:
 (1)  publish notice in a newspaper described by Section
 262.025(a) once not later than the 14th day before the bid receipt
 deadline; and
 (2)  post notice continuously on the county website,
 with a conspicuous link to the notice on the site's home page, for
 at least 14 days immediately preceding the bid receipt deadline.
 (b)  The newspaper notice under Subsection (a) must include
 the time and place at which the bids will be publicly opened and the
 Internet website address for the procurement information.
 (c)  The commissioners court shall publicly adopt standards
 to ensure that Internet posting of notice under this section is
 archived.
 SECTION 4.  Subchapter B, Chapter 271, Local Government
 Code, is amended by adding Section 271.0251 to read as follows:
 Sec. 271.0251.  NOTICE PUBLICATION IN POPULOUS COUNTIES.  (a)
 If a governmental entity located wholly or partly in a county with a
 population of one million or more maintains an Internet website,
 the entity, instead of meeting the publication requirements under
 Section 271.025(b), may:
 (1)  publish notice in a newspaper described by Section
 271.025(b) once not later than the 14th day before the bid receipt
 deadline; and
 (2)  post notice continuously on the entity's website,
 with a conspicuous link to the notice on the site's home page, for
 at least 14 days immediately preceding the bid receipt deadline.
 (b)  The newspaper notice under Subsection (a) must include
 the time and place at which the bids will be publicly opened and the
 Internet website address for the procurement information.
 (c)  The governing body of the governmental entity shall
 publicly adopt standards to ensure that Internet posting of notice
 under this section is archived.
 SECTION 5.  The changes in law made by this Act apply only to
 a notice required to be provided on or after September 1, 2011.  A
 notice required to be provided before September 1, 2011, is
 governed by the law in effect immediately before that date, and that
 law is continued in effect for that purpose.
 SECTION 6.  This Act takes effect September 1, 2011.
