99 AN ACT
1010 relating to maintenance of portable fire extinguishers in
1111 government-owned vehicles in certain local governmental
1212 jurisdictions.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. This Act may be cited as the Ariel Corley
1515 Memorial Act.
1616 SECTION 2. Chapter 370, Local Government Code, is amended
1717 by adding Section 370.005 to read as follows:
1818 Sec. 370.005. MUNICIPAL OR COUNTY POLICY REGARDING
1919 MAINTENANCE OF PORTABLE FIRE EXTINGUISHERS IN GOVERNMENT-OWNED
2020 VEHICLES. (a) In this section, "local government" means:
2121 (1) a county;
2222 (2) a municipality; or
2323 (3) an agency, department, or other division of a
2424 county or municipality.
2525 (b) A local government that adopts an ordinance, order, or
2626 policy requiring motor vehicles owned by the local government to be
2727 equipped with portable fire extinguishers shall require
2828 maintenance to be performed on the portable fire extinguishers
2929 annually in accordance with standards that are at least as
3030 stringent as the National Fire Protection Association Standard
3131 Number 10, Portable Fire Extinguishers.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2011.
