8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 456.003, Transportation Code, is amended |
---|
10 | 10 | | to read as follows: |
---|
11 | 11 | | Sec. 456.003. PARTICIPATION INELIGIBILITY. A transit |
---|
12 | 12 | | authority is ineligible to participate in the formula or |
---|
13 | 13 | | discretionary program provided by this chapter unless the authority |
---|
14 | 14 | | was created under Chapter 453 or former Article 1118z, Revised |
---|
15 | 15 | | Statutes, by a municipality having a population of less than |
---|
16 | 16 | | 200,000 at the time the authority is created. |
---|
17 | 17 | | SECTION 2. Section 456.006, Transportation Code, is amended |
---|
18 | 18 | | by adding Subsections (b-1) and (b-2) to read as follows: |
---|
19 | 19 | | (b-1) Notwithstanding Subsection (b), an urban transit |
---|
20 | 20 | | district that was not included in an urbanized area containing a |
---|
21 | 21 | | transit authority according to the 2000 federal decennial census |
---|
22 | 22 | | but, as a result of the 2010 federal decennial census urban and |
---|
23 | 23 | | rural classification, is included in an urbanized area that |
---|
24 | 24 | | contains one or more transit authorities may receive money from the |
---|
25 | 25 | | formula or discretionary program in an amount that does not exceed |
---|
26 | 26 | | the amount of funds allocated to the district during the fiscal |
---|
27 | 27 | | biennium ending August 31, 2011. This subsection expires August 31, |
---|
28 | 28 | | 2018. |
---|
29 | 29 | | (b-2) The population of a municipality that was considered |
---|
30 | 30 | | part of an urban transit district for purposes of the state transit |
---|
31 | 31 | | funding formula for the fiscal biennium ending August 31, 2011, but |
---|
32 | 32 | | that is included in a large urbanized area as a result of the 2010 |
---|
33 | 33 | | federal decennial census, continues to be considered part of the |
---|
34 | 34 | | urban transit district for purposes of the state transit funding |
---|
35 | 35 | | formula. This subsection expires August 31, 2018. |

36 | 36 | | SECTION 3. Subchapter B, Chapter 456, Transportation Code, |
---|
37 | 37 | | is amended by adding Section 456.0221 to read as follows: |

38 | 38 | | Sec. 456.0221. ALLOCATION TO CERTAIN RECIPIENTS AFFECTED BY |
---|
39 | 39 | | NATURAL DISASTER. (a) The commission shall consider as an urban |
---|
40 | 40 | | transit district for the purposes of the allocation of funds under |
---|
41 | 41 | | this chapter a designated recipient: |
---|
42 | 42 | | (1) that received money under the formula as an urban |
---|
43 | 43 | | transit district for the fiscal biennium ending August 31, 2011; |
---|
44 | 44 | | (2) whose population according to the most recent |
---|
45 | 45 | | decennial census is less than 50,000; and |
---|
46 | 46 | | (3) whose population loss over the preceding 10-year |
---|
47 | 47 | | period is primarily the result of a natural disaster. |
---|
48 | 48 | | (b) This section expires August 31, 2018. |
---|
49 | 49 | | SECTION 4. This Act takes effect September 1, 2011. |
